I think "it" in his sentence refers to replacing the shifter shaft seal not the transmission. It is completely illogical and not believable that after several transmission replacements a shaft seal would still be leaking.
 
Depends on the State laws, and your a fool if you don't maximise the law to your benefit. I don't give a hoot about frivolous law suits, but 50K for a truck they can't fix and and then want to charge you for, after the warranty is expired. In my book, the OP has every right to sue. Same problem over and over without a fix, then want to charge you. If his documentation proves he's given Dodge several chances to repair something that is a manufacture defect, then he should pursue Dodge for a new trany. Dodge has the upper hand in bulling the OP with all their money and attorneys (and now the government) in their pocket. It is why the Lemon Law exists.

OK, you want to nit pick. :rolleyes: I know it was a seal repair, however if three atempts are performed to fix any problem that are not resolved in those atempts, it qualifies for the lemon law, espesially being a major component.

Bob I agree with that, but there is proof from the performing dealer that during the 3/36 it was not repaired, and any attorney could prove that, if there is documentation. However I'm not an attorney, so I would seek legal advise with the documentation as to my rights. I also would not think twice about it, as HBarlow seems to think the OP should just shut up and take the loss.

I won't pretend to know that its serious, because we don't know the details, only the OP Knows. But Dodge seems to think so, because they attempted several repairs.
 
Dealers often attempt to repair or pretend to attempt to repair minor or imagined issues simply because a customer complains. That does not mean a complaint is serious or that the dealership thinks it is, only that they are attempting to please a customer and keep him as a customer.
 
Well now that it's an imaginary repair with an imagined leak on an imagined invoice I guess the OP is imagined as well. :rolleyes:

Just because a dealer attempts to repair a leaking seal does NOT mean there is a case for lemon law.

Since either the OP neglected to mention it or I missed where he is located, I'll go by WA law as I'm most familiar with it. It has to be a defect that substantially impairs the use, value, or safety of a vehicle.

A leaking seal (imho) isn't a substantial impairment.
 
I still would seek an attorney, and then see what happens from there. I would not sit around and smoke crack, just because somebody told me I didn't have a chance. There is so much we don't know about his circumstances, so to advise him to sit on his hands is wrong. BTW will you pass that crack pipe back my way. :-laf
 
I am a heavy equiment mechanic with over 20 years on the job i have serviced this truck from day one it is not that the seal keeps leaking the seal don't stay in the case. The dealer has thrown every part they can at it from seals to a new shaft now they want to throw a case at it. If they realy want to help they should repave his drive way were the atf has ate a hole. There is a lot more to being a mechanic then changing parts and i know there is alot of good mechanics on this site that would agree. So back to the transmission when the new seal comes i will prick punch the case and put a little bearing mount on the seal and end this transmission leak for good
 
If the seal doesn't hold and it's determined that the case is out of spec, what is your recommendation to the OP? Would you rather see a new trany over the replacement of the housing?



Thank you for your clarification on this thread, I didn't think a seeping seal would warrant a dealer to replace the case, just to satisfy a customer.
 
There is know way i would let the dealer change the housing if dodge wanted to pay to have a transmission shop do it then yes i would say change it.
 
Why not leave it alone then, instead of stirring the pot?

What I'd like to know is what the heck is causing the seal to pop out. That's nuts.

By "critics" are you referring to the earlier posters in this thread who actually know what they are talking about?

Knowledgeable members like Bob4x4, Mike Wilson, Bill Stockard, sag2, and others explained quite well why they consider it preferable to let the dealer who sells and services the Dodge Ram automatic transmission replace the case.

Continue to babble on in the darkness if it pleases you. No one is paying attention.
 
I have a 2008 2500 45k on it. the transmission has leaked from day one from the selector shaft. Its been replaced several times and even the shaft itself. Now the dealer wants to replace the transmission cases they say their is probably a problem with the machining on mine. I'm concerned for this seems like it is probably to big of a task for the dealer a transmission is a complex thing.

Any thoughts.

My advise was to seek an attorney because it seemed to me to be a major repair that was never fixed and would be under the lemon law. Then comments from HBarlow and Cosmo tried to minimize the advise, Bob4X4 commented thinking warranty was over? As it turned out, it was not just a small leak, and indeed with the new knowledge about the seal popping out of the case, is major.



As typical of HBarlow, he resorts to brow beating when it doesn't fit into his narrow thinking. To not know all the circumstances and recommend the OP just sit around and smoke crack, sorry Cosmo, is wrong.
 
I and Chris have over 60 Years of sweat and Blood experience,We have a box full of plagues that just stay in the closet,Dodge can Keep their certification... . it is flawed. . Does the dealership have a transmission-Dyno? Hmmmmm Every major transmission builder I Know does. So how could you even say the dealer has the tools to do it? Of course you can tear it down and R/R and it may work Perfectly or it May Fail, But NO owner should have to even consider this procedure.

Their are Many knowledgeable dealer techs,its wrong for Dodge to force the dealer tech to attempt a repair without the Dyno, I agree with RMcKeena,I cannot count the times we have used aluminum-pigment to get seals to stay,Punch or shim.
 
There is no pressure behind that seal,so the dealer looking at the truck has come to the conclusion that the case was machined improperly to hold the seal after replacing the seal a number of times.



A dyno is not needed to repair a Trans :-laf:-laf:-laf. Now if the Trans has been modified of course before shipping it across the country it would be a good test to verify it's operation.



Every certification program is flawed. ASE is one of the biggest jokes around. It is a private company that fed it;s way into existance to fatten it's own coffers preying on paranoid consumers. We can look to the medical community as well as the lawyers. There will always be that 10 % in any group
