Taking your hitch out must be a state law. I've never heard of such a thing in CO. Mine is in most of the time.
As was said earlier, I'd closely check your hitch for damage. My bro had a Cherokee that was rear-ended a number of years back. When they closely examined the hitch, it was bent. I seem to remember it causing damage to the frame as well?.
