Took truck to dealer Friday the 17th for some last minute warranty work very minor and dealer says warranty expired June 2 2004. Wait a minute I purchased the truck Sept. 20, 2001. The vehicle information papers from Dodge says the in service date was June 2, 2001. After a call to Dodge they said it was probably a woops and the in service date was inputted incorrectly. I think that I might have been screwed and sold a used truck for new. Carfax shows me as the only registered owned but who knows what could have happened.

I agree - your sales contract will put you on solid ground. Stick to your guns and stay on 'em until they take care of you. Keep going up the ladder until you get someone that makes sure that your issues are corrected. I've found that under these types of circumstances being polite but firm works best for me. I had a service mgr. tell me, "No way am I doing that" over a warranty issue (having a mechanic test drive my Ram without a state registration/license on it). Well guess what - I went to his boss and asked him, "Let me get this straight before I am compelled to seek legal remedy and recourse, under the circumstances your dealership is refusing to honor this warranty???" The service manager found a way to do what he said he wouldn't do after his boss told him to handle it, and now we're good friends.



How many miles were on the odometer when you took delivery, anyway?

2625 miles when took delivery. Presently 32339 miles. Was inter dealer trade and I am afraid it was sold at the previous dealer. That would establish the in service date of 6-2-2001.

Did they represent this truck to you as 'new'? For example, the definition for a 'new' car according to the Texas Transportation Code is one that has never been subjected to a 'first sale' and that is:



(5) "First sale" means:

(A) the bargain, sale, transfer, or delivery of a

motor vehicle that has not been previously registered or licensed,

with intent to pass an interest in the motor vehicle, other than a

lien, regardless of where the bargain, sale, transfer, or delivery

occurred; and

(B) the registration or licensing of that vehicle.



So someone 'used' that truck without it being registered. It happens all the time. Who was it? Who knows, maybe a brother-in-law of the dealer or a buddy of the sales manager - there's no telling. It was most likely driven for those 2,600 miles with one of those metal DEALER tags on it. Whoever sold you the truck wasn't telling you everything. How did they explain the 2,625 miles? You may have an uphill fight because of the date issue, depending on how much of a jack*** the service manager wants to be. If it were me I would stick to my guns based on the fact that the truck was represented as 'new' and therefore the buyer should receive the actual and full '36/36 warranty', not some abbreviated version because someone misled you. If you can, document everything you've done recently to establish that you have diligently pursued the repairs under warranty in a timely fashion, then continue to wear them down, but in a nice, friendly way. ;)
