Vaughn... it would have to be from 35,000 or 37,000 ft. 36,000 is an altitude that is not used, except for climbing/descending!
Oceanic is now using less seperation... they use 1000 ft between aircraft above 29,000. Always used to be 2,000ft. ie: if you were out on a ship, you could likely get hit from 36,000ft!!
