Guys, I've been ALL over the net for hours... ..... and can't find anything on this issue: I won a small claims case against a guy that assaulted me back in 1996--won a few hundred bucks. Unfortunately, his ex-wife beat me to the garnishment of his wages. :( Basically I thought I'd wait a long while then renew the judgement, and someday go after it. Well, turns out he's found ME, and wants to cough it up. BUT, I can't find anything about what interest rate I use to calculate the interest over the past 5 years. I'm in Oregon, and one website said Oregon uses the T-bill rate plus 4%... ... ... OK, but is that the current Tbill rate for the past 5 years, or what? Appreciate any input if anyone has ever dealt with something such as this. Can't find squat on the net, and I've been on here tonite for hours!

Considering what you've posted and the current societal state of affairs..... you may want to accept the original judgement amount, forget the interest, shake hands, and move on with life.

The fact that the man looked you up to do the right thing makes me agree with Papa Joe. But, it's your money. ;)
 
While Papa Joe and Don have good advice---a bird in hand is allways somewhat better than one in the bush and collecting a judgement can be MUCH more difficult than most people think. ---(with 38 years in the business, I have a couple I can't collect. )

The applicable rate of interest in Oregon is set by statue and is called simply enough," statutory interest". As of the time I retired in 1999 that was 9%.
 
You're lucky you even heard from him again! The people I've known who won those things still had to fight like h@ll to get paid because even though the judgement was for them, the courts usually don't have a system established to make the loser pay. Better take what you can get!
 
Thanks for the replies! I plan on making one attempt to determine what the interest may in fact be, then advise him what the total amount would be including interest---and give him an olive branch to pay off the entire thing in 30 days interest free.



Most importantly is the fact it would be gone and he would be gone..... he is a fruitcake that has been locked up countless times for "going off" and doing to others what he did to me---he does have a good job, and apparently is trying to get this out of his hair so he can move on, so moving on is good for all of us... ... ...
