My daughter has a new Dakota that died. The dealer said the computer died and could have destroyed the engine. She has under 3K miles on it, it has been down 3 weeks and will be down another 3 weeks to 3 months since parts are not available. It will be at least 3 weeks before they know if there is any engine damage. It seems that this severe a problem for a new vehicle should call for the car to be replaced.

Can you tell me where we should go next? See a lemon law lawyer?
 
1) My dealer's policy is if an under warranty vehicle is down for more than a day I get a FREE rental of equivalent size and value (or as close as they can get -- they don't have diesels for rent so it's usually a decent gasser half ton).
2) They should be willing to replace this vehicle instantly. Call Chrysler's 1-800 number and get the ball rolling on it. The dealer isn't the one that has to pay for it, Chrysler does. A new vehicle dead for that long is a no-brainer replacement for the corporation -- no lemon law required.
3) If they can fix it 100% good as new they'll just resell it anyway. Someone will get a good deal on a barely used vehicle. Again, ChryCorp should replace the vehicle w/o much complaining if it's really going to be dead that long.
4) Keeping me in a rental for over a month would cost the dealer as much (net) as letting me have a new vehicle at cost -- since they can resell the old one. They do have your daughter driving a dakota or better I hope? If not then do that asap. That'll get them looking for a solution instead of delays.

I would not put up with that. Parts cant be that hard to get. Tell them you want a new truck. Get on their a--. They could take the computer off another truck. Start with area zone manager. You may need to get a lawyer. In my opinion you are being screwed around. Hang out in the sales area and tell everyone what happened. They changed the oil in my sisters neon and left the filter loose. Lost oil pressure on its first oil change. I had to park it in front of the dealer with a piece of s--t sign on it,but they did replace the car. Only had 1500 miles on it. They take advantage of women.
This was (is) a five star dealer. LOL

Sorry don't have any construtive input on this other then sure sounds like they should replace the vehicle to me.
 
6bbl: Jim's Dodge?

They failed to tighten an oil feed line on mine, blew out 2 gallons of oil in six hundred miles. What a mess. Good thing I had a couple gallons in the tool box.

They also file warranty claims on parts they don't replace. I started marking the parts so I could tell. Was wondering why I could get all that work done and nothing ever was fixed, so I started marking parts.

Now I commute to Woodhouse in Blair, much more honest. Jim Earp is a bunch of lying crooks. But hey, Jim's Dodge is Five Star Crooks, you know, the really good kind.

Under standard warranty they do not supply rental vechicles you have to have an extended warrnty. Immediately request arbitration, they have to schedule and have it settled in 45 days, and call everyday to request updates. find out where the zone office is and drive there and raise cain. If they have not gotten the problem repaired in the 45 days the car will be bought back or replaced. I know I been through the process 3 times and am a 3 time buyback/replace customer. KEEP THE PRESSURE ON THEM DC HOTLINE) AND KEEP REMINDING THEM THEY HAVE 45-44-43 ETC DAYS TO SOLVE THE PROBLEM. The DC line is where you want to put pressure on get the dealer to put in writing the repair estimate and the time required to complete it. Patience and you will win.
 
Anytime I had warranty work I got a car and it was the plain old ordinary warranty. I never had to ask either.
Maybe its another SCAM.

Seriously though, ask the dealer principle for the number for the regional DC warranty rep. If he cannot give it or will not, then ask for him to call them with you present. Ask them when the DC rep will be in or call another dealer in the area and ask them.
You gotta balance your frustration with assertiveness. Tell them what you expect.

As a former service writer I can tell you that loaners are dependant on the dealer's policy. I would demand that the dealer pull a computor of another vehicle, you shouldn't even have to ask for that. If they drag their feet in the slightest, go for arbitration, get out of the vehicle (only takes have as long as the repair)and never do business with these scoundrels again.
If there are other dealers in the area, you might check to see if they will help with the problem first. It sounds like these guys aren't the brightest. A call to the owner might help, just don't be unreasonable or piss him off, he may have a bad manager and not know it.

I have had more than my share of problems with my new truck and local dealer. I am already pursued inspection and repair at another dealer and have scheduled a meeting with the District Manager. It took lots of fighting though.

The loaner car policy is a (bad) joke. The first time they had my truck for major warrenty work I demanded a loaner. The Service Manager quoted $35 per day for a rental neon. I talked to his boss and reminded them that when I was looking to buy a used truck they were more than happy to lend me one for the weekend. The next thing I know the used car manager walks in with keys for a used Ram. It wasn't a Cummins but it worked for the few necessary days. Always remember the used car lot is full of potential loaners...

But beware! In some states the Lemon Law "days out of service" count is suspended if they give you a loaner vehicle.

No Mark it was the dealer in Lincoln. New guy on the oil rack. They actualy told me no damage was done and even if there was she bought the extended warranty. LOL Boy I was a real pain in the a-- till they replaced the car. She has had no problems with them since,but I showed her how to make sure the filter and plug is tight on her own. Like I say they take advantage of women,she would be better off going to a local garage but is afraid of warranty problems if the engine blows. This way they have records. Will not let a dealer touch my truck even if it costs me money. The longer you keep your truck out of the dealer the longer it will last.
