Just a though here, but the NHTSA can force a recall on vehicles if the problem can be considered a safety issue.

Here's my thinking.

The KDP can cause the gear housing to crack causing oil to flow down on the passenger side of the engine. This can cause oil to be blown by the fan onto the exhaust system causing a fire?

First of all, is this a possiblilty or am I way out in left field here.

Second, if enough people complained to the NHTSA about hte problem would they do anything about it?

Hey, it worked with the throttle cable, maybe it would work for this.

Anyone have another safety issue that could be caused by the KDP?

Ya... I've got a safety issue related to the kdp. Judging from the responses of some of the members here, I feel that the safety of the dealers is at risk. We wouldn’t want anyone going postal in a dealership after a kdp cost them an engine. :D

oil slick on roadway... .

irate CTD owner on roadway... .

an engine fire isn't too much of a stretch either... . some folks may drive until it don't drive no mo'... . and it could catch fire... . oh wait... . we're not driving F*rd Exploders... . :p

It's worth a shot... all they can say is no...

If the pin comes out just right it can go in-between the gears, bend the camshaft and stop the engine dead. What if this happened in an intersection, passing, or freeway? I'd say it would be a safety problem. No throttle in an intersection is what got the throttle cable recalled, dead engine would be just as bad. Problem is when you file a claim with the NHTSA they want to hear about the hazardous condition not just it's possibility, i. e. your oil leak would have to catch on fire, if it just leaked they would toss your claim. They like it even better if someone gets hurt or killed. I think for the vast majority of our KDP failures we would have to BS in order to get them to pay any attention. If you do file keep your report short and to the point. It's interesting to check out the claims here http://www.nhtsa.dot.gov/cars/problems/complain/comp1.cfm?SearchTopic=Vehicle there are tons of them. Best one for my '95 manual trans - Truck started in gear and proceeded to drive away while catching on fire. I watched from my front porch, no one was in the truck.
