The wife and I had plenty of time on our long trip to do some serious talking about alot of things and the subject of a will came up, we currently have nothing on paper and figger we need to get some legal advise on this. It is surprising how much our worth has gotten to be and has the potential to be, We both work at the same place and the risk is high , we also carpool together daily so a tragidy there could be 2 fold, all our days off are spent together as well, what I am getting at is there is the potential for both of us to go at the same time leaving the trust to the state and I dont think that would be good at all... ... ... ... ... ... ... ... ... ... Advise please.

Sit down with your MRS and discuss what goes to who. Make notes. Go to an attorney that does wills. If you do it right, your survivors might be able to skip probate. PM me if you'd like more details.
 
Mrs Doc and I had the same conversation on a trip not long ago. We are in the process of making the will (waiting for the lawyer to draw it all up).

You hay think you heirs have been will provided for, but did you know that:

1) Your loved ones may have to wait more than TWO hears before receiving a penny for your estate---even though you have lift a legally valid will?



2) Cost of probating your will may eat up MORE than 10% of your estate----money your heirs will never receive?



3)The specfic instructions of your bequest may be contested or changed Completely---even though clearly spelled out in your will?



4) Once a will is probated, it becomes a matter of public record----Anyone can access the information just by going to the courthouse and asking for your file?



5) A will cannot help you in life? If you become incapacitated or you judgement comes into question, it becomes a matter for the courts to decide and is, again a very public process.



Find a lawyer that specializes in Living Trusts, VERY IMPORTANT.

Nah, just make sure you get your trust or will taken care of soon. I lost an uncle last year who was sitting on quite a bit of assets and cash. My cousin, the sole survivor of the immediate family is still waiting to get anything due to my uncle not having anything really well put together. He left a heck of a mess for my father who was setup as the care taker of everything.
 
Whitmore, trust or will is a debatable situation, but the best is to talk with an attorney to find out what is best for your situation. So , make an appointment today, yes TODAY, and have it done.

Death may be a long way off in the future, but *now* isn't a bad time to visit a laywer and inquire about wills and trusts. You don't necessarily need to take action any time soon. Look the info over, let your brain digest it. Get some more detailed info, digest it. In time, you will have enough info and a good enough understanding of the law to be able to decide just what you want to do to best protect your assets.
