Here is the latest. The grounds were backprobed and nothing was foind to be bad. The ECM was unpluged and no it wont act up. Cummins feels that the ECM is bad and we are looking into the Federal Emmision warranty. > Crossing fingers <

I will know in a few hours weather it is covered or not.

ECM is covered according to my book

Hi Jonz:



Maybe someone else has already done this but I started fuming when I read that your dealer wanted to charge you for the replacement of your ECM. My warranty book [# from back cover] is 81-016-1009(4/00) and according to it your ECM is covered.



Of course I am assuming your truck has less than 100,000 miles

on it?



My truck is a 2001, 3500 (build date 12/2000) got the warranty book out and did some reading. Reviewed pages 16, 17 & 18. On page 16 under "Diesel Engine Medium Duty Trucks" it states: "The California Air Resources Board and Diamler Chrysler ... cont'd .



This section is stating that your emission control system is covered in California.



Review the top of page 17 for covered components which states: " Your emmision control system may include parts such as the fuel injection system and ENGINE CONTROL MODULE [emphasis added by caps].



Covered period is for 5 years or 100,000 miles. OR for 7 years or 70,000 miles [top of page 17]"1. Where a warrantable condition exists on a long-term emission-related part, ... cont'd "LONG-TERM EMISSION-RELATED PARTS: are defined on page 18 [right column]. On page 18 it states: "Coverage LONG-TERM EMISSION-RELATED PARTS: Cylinder Head, Engine Control Module, Fuel Pump and Turbocharger.



I can't believe your dealer is giving you a hassle over the ECM replacement.



Go get em and make them fix your truck OR BETTER YET - FIND ANOTHER DEALER who wants your repeat $30,000 of business.
 
ECM warranty

OK..... heres the deal. The warranty book has the ever evasive word "may" used when refering to the components warrantied and the person who makes the call is denying it. We are persuing a higher lvl and see what that does for us.



Latest vehicle condition. After all the testing and probing the truck has decided not to act up anymore. Go figure. We are still pretty certain that the ECM is the problem.

O. K so your dealer wants to play word games does he. Page 17 uper right hand corner states and this is a direct quote:



"For 7 years or 70,000 miles, whichever first occurs:



Where a warrantable condition exists on a long-term emission-related part, Daimler Chrysler Motors Corportation will repair your truck at not cost to you including diagnosis, parts and labor. This is your LONG-TERM EMISSION CONTROL SYSTEM DEFECTS WARRANTY. "



Now there is no MAY, COULD, MIGHT BE, EXCLUDED FROM or any other descriptive noun or verb for them to use. Stick to your guns and stand up for your rights.





Remember from page 18]



"LONGTERM EMISSION-RELATED PARTS: [are]

Cylinder Head, Fuel Pump, Electronic Control Module and Turbocharger.



Next step is to have already prepared [and take it with you to the dealer] when;and if; they say your ECM is not covered again, a letter specifically requesting the dealer define/identify the emission control system components covered on your Dodge Truck. Tell them you want the defined components on Dealership letterhead. Take this letter directly to the Service Manager and stand there UNTIL you get a specific date [not more that 5 days] to come to the dealership and pick up their response.



During the time you are waiting for a response from the dealership [better yet when you get home from the dealer] call Daimler Chrylser at 1-800-992-1997. Make sure you tell them that you will be calling the California Air Resourses Board (CARB) to voice your concerns about a dealer that fails to repair emision control systems under warranty. When you are talking with Daimler Chrylser make sure you have your warranty book open and quote the exact paragraphs to the customer service representative. Also make sure you tell them the dealers name, address, TELEPHONE NO. , Service Managers name and what YOU BELIEVE is a failure to honor the emission warranty on your truck. If I know Daimler Chrylser THEY WILL ACT however if they don't:



Call the CARB and give them an ear full. They might just be looking for a dealer who does not fix "emission-related parts"



It is unfornate you have to go through such a hassle to get your truck repaired. My dealer would never try to pull such a stunt.

OK... Im all fired up and ready to take them on. Heck I got Tom and the TDR behind me right..... :)



Great advice... ... . The mechanic I am working with is taking the warranty up with someone else and I will have word in the A. M. He has my warranty book so I cannot see what it says in person. Tomorrow I will head down there and square things up best I can in person. He is on my side and thinks they should warranty it as well but he does'nt make the calls.



I appreciate all the info Tom. I have printed it out and will keep it close.



Tomorrow will tell alot more.



BTW, when you said "my dealer" are you refering to a dealership you work at?

Your question about 'my dealer' means my dealer here in Lake Havasu City, AZ. I don't work for an dealer since I am just a poor old country boy trying to get along ;-)

ECM Warranty

Well, after much nail biting I am happry to say that Dodge will warranty the ECM. I will have it in about 2 weeks. Thanks to the tech who was working on my truck. He made it all happen.



Hopefully this solves the problem and I can drive off into the sunset once again.



Will update as soon as the ECM transplant takes place.

Bravo to the tech that fought the system to do what is right!!!!!!!!!!! There are some good techs and even some great ones, the trick is in finding them. Glad you are getting it fixed too.

Ah yes, the sweet smell of success. It only takes one person and that was you to stand up for what was right and success was achieved. You stuck to your guns and they finally realized you weren't going away. Feels good huh :D
