Ford Motor Company v. Mayes is a Kentucky, 575 S. W. 2d 48, case in which Ford was sued by the Mays following Ford's inability to repair their truck to the Mayes satisfaction. Ford relied upon their warranty language in stating that the Mayes only recourse was the repair and or replacement of defective as parts might fail within the warranty period.
The Mayes contention was that Ford had to either replace their truck or buy it back as they had been unable to repair it.
The Kentucky Court of Appelas agreed with the Mayes, stating that if Ford was unable to repair the truck within a reasonable amount of time, then they had failed to comply with the supplier's warranty policy (despite the language of the policy) and found in favor of the Mayes.
