Boulder DA: No charges against homeowner who shot intruder, CU student Zoey Ripple, 21 - Colorado Daily

Citing the "make my day" law, officials announced Thursday that no charges will be filed against the man who shot Zoey Ripple, 21, after police say she drunkenly entered his home early Wednesday.



The Boulder County District Attorney's Office said prosecutors will decide in the next few days whether to file any trespassing or other charges against Ripple, who is listed as a University of Colorado student majoring in speech, language and hearing sciences.



The owners of the modern, 4,000-square-foot home at 425 College Ave. are Timothy Justice and Doreen Orion, according to county records. They are both psychiatrists, and Orion is also an author.



Police said the husband and wife were in bed when they heard noises outside their exterior bedroom door at 3:30 a. m. Wednesday. The screen door was closed but unlocked.



In the darkness, they shouted to warn the intruder to leave and that they had a gun, but Ripple continued walking through the bedroom, and Justice fired one shot, police said.



When the homeowners turned on the lights, they saw Ripple on the floor with a gunshot wound to her hip and called 911, police said. They said they did not recognize her as anyone they knew.



Officials said preliminary tests indicate that Ripple's blood alcohol level was above 0. 2 at the time of the incident.



In a recording of the 911 call, released by police Thursday, an upset Orion told the dispatcher, "Somebody came into our house, and we shot them. " She went on to say: "She came in, and we started screaming at her to leave and she kept coming in. "



Orion told the dispatcher that the woman was sitting up and talking on her phone after the shooting but seemed "kind of stoned or something" and wouldn't answer questions.



At one point, Orion asked Ripple, "Why did you just walk into our house when we were screaming at you to get out?" The answer was not audible.



Orion said the gun used in the shooting was a Glock.



The home where the incident occurred, listed for sale at $2. 75 million, is at the western end of Boulder, where College Avenue dead-ends in the foothills.



DA Stan Garnett said the evidence in the case "fit the type of circumstance to which the 'make my day' law applies. "



"This was an unfortunate incident for the homeowners in this case, who are understandably upset by what occurred, and for Ms. Ripple, who could have been fatally wounded," Garnett said in a prepared statement. "It is also unfortunate that we see a lot of incidents in Boulder where people become so intoxicated that they illegally trespass into another's residence. Luckily most of them don't result in someone being shot, but as this case illustrates, it certainly is a possibility. "



Under the state law, homeowners are allowed to use deadly force if a person enters their residence uninvited and either has committed a crime other than trespassing in the residence or intends to. Homeowners are also within their rights to use deadly force if they reasonably believe a trespassing person intends to use any measure of physical force on any occupant of the home, under the law.



In an interview, Garnett said similar intrusion cases in the past have led to charges of first-degree criminal trespass, which are less serious than burglary charges.



"Ms. Ripple is still in the hospital, from what I've been told, so there is no rush on this," he said of the decision whether to file charges against her. "We also want to talk to the homeowners. We always talk to the people affected ... when it comes to the filing of charges. They won't get to make the decision, but we want to see what they have to say. "



Colorado court records show that Ripple was previously arrested on suspicion of shoplifting in Broomfield in 2010 and pleaded guilty. Court records show the charge was dismissed after a deferred sentence.

Reason being they dont testify very well that way

yep, pull the trigger till the gun clicks so you can say; i dont know how many shots i fired. i was in fear for my life and shot until the gun was empty.

there is always a lawyer out there that will sue you, and try to put you in jail for defending yourself.

Amen My Dad alway's told me if your going to shoot somebody make sure they aren't moving still when you empty the gun so yep 20 round's of 45 should do the trick 45 makes a mess but dead people don't talk
 
She's lucky to be hit in the hip... . my wife likes the 12ga, which I have loaded with buckshot for lethality..... She'd have been cut in two if my wife had shot her, and I'd have double tapped her over my Sure-Fire light..... maybe even both if she hadn't stopped walking in... . My concrete floors clean pretty easy... . Poor kid, too stupid to know her own decisions brought this on her... . Now she'll probably sue in civil court... . or does the Colorado law protect the shooters? :cool:
 
it doesnt really matter if the law protects the shooters. if there is a lawyer willing to take the case, and there always is, there will be a lawsuit no matter how frivolous it is.
 
Gotta figure out a way to prop them up after the second shot.

Once they're down, it could be murder.

Just sayin'.

I like the Grandma from Texas tho, she was asked why she shot the intruder 6 times. Her response was, "They don't make a Seven shooter".
 
The media doesnt mention this, but the CU Boulder campus is not far from this Home. CU Boulder and Boulder itself is the local bastion of liberalism. For many decades, students from CU have made "statements" against the "establishment" by challenging basic common sense!

The person or property of another has been targeted many times just for fun, to make a statement or just to stir the pot by creating notoriety.

I worked in Boulder for 7 years for a local gas utility. Needless to say, the locals are a very unique bunch!

IMHO, It has occurred to me that the young woman who was shot may have been trying to make a public/political statement. She may have been coerced, challenged or chosen by her peers to be a sacrificial lamb, as it were. Or part of an initiation rite. Stranger things have happened

A previous arrest record does indicate that she is not making good decisions and may be targeted by those that look for weaker members of their peer group to use for selfish goals, regardless of the harm that may come to them!

Targeting a "rich" home/homeowner, using yourself as bait after consuming large quantities of liquid courage. Sounds like a poorly planned attempt at larceny. Sacrifice your health for the proceeds of legal action. Unfortunately, the instigator did not interpret the Law correctly. Hmmmmm:rolleyes:! In Colorado, "Make My Day" precludes civil action by the defendant against the defendor.

HH, Thats for sure. Our new Governor is the former mayor. During his tenure, was accused of making Denver a Sanctuary City for illegals. He denied it, of 'course:-laf.
It goes far beyond that one symptom, however;).
It wasnt always this way!
I remember the old Cowboy Town from back in 1970. The Governor, State House and Senate were overwhelmingly conservative and the Denver Mayor was griping that Denver was not respected and needed to be like Kansas City, Chicago, St Louis. Et Al.
Well! They sure got their wish! With all the negative crap that goes along with that "New Found Respect":rolleyes:

One thing that really gets me is that our last governor, "Tax Ritter", placed all concealed carry permit holders on the County of residence Criminal justice record.
Per 18-12-206 (3) (a), Sheriff's Offices are only allowed to share applicant information with other law enforcement agencies. No information on an applicant is released to the public. The information requested is classified as a criminal justice record covered by Part III of the Open Record's Act. The Act states that the custodian may deny access to criminal justice records when disclosure would be contrary to the public interest. 24-72-305(5) C. R. S.
That includes the Colorado Crime Information Center Database.

GHarm, that was required by federal law. The mandate is handed down from legistlation passed (like they needed more!) that prevented the ATF and Homeland security from creating and maintaining a list of gun owners... . a registration scheme. That was part of the national gun clubs and the NRA coming together and standing thier ground. Something about criminals targeting home owners registered on the list, knowing they owned guns..... Luckily, that day common sense prevailed.
 
HH, That is Correct. However, The licensed CCW holder, in Colorado is still on the Colorado Crime Information Center Database. That is not the same as the C. R. S. wording and requirements. It is endrun legislation grouping licensed CCW holders with known criminals. GregH
