Too much throttle with my fiver in tow got me a warning from an Arizona trooper who, smelling beer on my breath, asked how many I'd had and when told it was O'Doul's N/A beer he verified the statement by examining the bottle but then had to call his desk to see if "Less than 1/2 of one percent" alcohol constituted an "open container". The desk had no idea and left to his own decision and my harping about the "Non-alcoholic" label :-{} on the bottle, I was free to go. An e-mail to Bud elicited a quick response and when asked if this was a problem that had come up before, I was told it had not. I have received some literature in that regard from them which I intend to share with the ADOT folks. Now..... was this trooper just too new to know or was he a practicing Adam Henry? :D Oh... BTW... . I was carded at the Dangling Rope Marina store for some beer... . I'm 71 (although I have been told I look younger..... maybe 65) :-laf

Great story! I'm not 100% sure, but I would think that it would not be considered an open container, seeing how its N/A. I've never personally had the stuff, so I wouldnt be sure, but you can drink that to your little hearts desire and still be legally able to drive correct?

I consider being carded a honor. If they think I look that young or if it is store policy, I smile and present it without any fuss, cause I keep it in my mind that it is my boyish good looks that get me carded :-laf

O'Douls is not an open container. Non-Alcoholic is just that. It may technically have alcohol but its so low as to be impossible to get drunk from it. You'd drown, suffer kidney problems or piddle yourself to death if you could consume it fast enough to get drunk...

When I was about 12 my family went on a tour of the Bud plant, and at the end, they give you a token for a beer, or other kind of drink. They could not serve me O'Doul's because of it's . 5%.

Under that example:

Was it an open container? Yes.

Did it need to be enforced? He|| No.

Food for thought.

As much as I hate to add to the delinquency of the delinquents, a good Hiway Patrol bud of mine told me that guys who get stopped while having an open container aboard, should simply dump it on the floor - an EMPTY container can't get you ticketed, and it's cheaper to clean up spilled beer than it is to pay a ticket... ;) :D

Do you think it would cause a problem sitting in the workplace at your desk drinking a N/A beer rather than a Pepsi or Coke?

How about one with lunch?

FYI - The FAA considers N/A beverages that contain small amounts of alcohol an alcoholic beverage in regards to their 8 hour bottle to throttle rule. I recall a letter to all airmen a number of years ago letting us know that.
