its a darn shame that any judge, district attorney or lawyer would even allow such a suit to be filed.



the law no longer has anything to do with right or wrong. it also has nothing to do with personal responsibility or "real" liability.



poor CAT, this is going to cost them (and any one that buys a machine) even if it never does go to court.

I do not understand that one bit. How is CAT in any way responsible for what and or how their equipment is used? Of course that blade was not designed to kill, it was designed to demolish. Reading about lawsuits like that make me sick. I could possibly understand an attempt at a lawsuit if something failed due to a defective desing causing an unfortunate accident, but if you are stupid enough to stand in front of a dozer, that is your fault. If any blame is to be placed here, it is on the idot who stood there.



I am sure that the friends of that person will never stand in the way of a 27ton D7 or anything large and yellow again. I also agree with ARedetzke, it is called "Natural Selection"

CAT should sue the parents of that idiot for expenses incurred after that stupid lawsuit is rejected. That kind of BS pisses the hell out of me.

This woman is a lunatic. She's trying to make it sound like the poor guy driving the dozer DELIBERATELY ran over this tree-hugger... . he probably didn't even see her over the top of the blade. I also like how this happened 2 years ago, in March 2003. How come this is just coming to the surface now? Did it really take this long to get it blown enough out of proportion for the media to pick up on it?



People that do this sort of thing **** me off, why don't we just sue the oil companies because the exhaust from the cars they power is killing people and causing acid rain, makes sense to me :rolleyes: That oughtta jack the price of gas through the roof, kinda like how Cat is going to have to increase prices to counter the cost of this lawsuit.....

Even if the operator did DELIBERATELY run over the tree hugger, it still isn't CAT's problem. This is just another example of a looser going after deep pockets, maybe if their parenting skills had been up to par their "child" would have known better than to get in front of a bulldozer.



Morons and our moronic legal system that tolerates nonsense lawsuits like this really get under my skin...

It wouldn't surprise me if he did deliberately run her over. The Israelis are a tough lot, they put up with stuff on a regular basis that we will never see in our lifetime. When you're the lone Jewish state, in a region surrounded by people who want to drive you into the sea, you have to learn to take care of business. That's what that hippie tree hugger gets for messing with Israel, she deserves what she got. If she would have just minded her own business, she'd still be alive, no one is to blame but her. I know it's harsh, but it's also the truth.

I vote we remove; Air bags, ABS, Traction control, etc from cars. If you can't learn to drive. Or better yet (ladies) not panic! You deserve to do a face plant into the steering wheel. HECK with manditory seat belt laws. If people are to stupid to wear them..... NATURAL SELECTION! We keep making it easier and easier for the stupid people to survive, pretty soon we are going to be over-run with stupid people!

What a miserable way to go... . might have been a glassy eye situation and she didn't even know what took place... Rachel should have been tending to business at Evergreen College in Olympia and not galavanting half way around the world sticking her nose in someone else's business... She could have been tree hugging in the State of Washington. . Having a felled redwood drive her into the ground would have saved her parents a funeral expense... . Then suing an out of country business like Husqvarna would have been a different story. . Any way, her problems are now all over, and she know doubt is now in a "better place". . I still say she shouldn't have skipped school!

Being in the tree service myself the I told the boss about some shirts on ebay. Now weve all got em :) "Tree Huggers Su*k" and wear them proudly! Yet no complaints just praises!
