Question about out of state purchase for cal use

A friend of mine is going to buy a 03 here shortly.



I am advising him to purchase one outside of california, as he can get the "HO" package, not the watered down cummins in Ca. ( i'm going by the few posts I read here. . )



Has anyone bought a new CTD and registered it in ca ?



Any problems or fines with DMV etc?



last question is; he wants the model with running lights. I know 3500's have them, but I've seen 2500's with them.



Is that a option or a different package etc?
 
I came back from Colorado last week with my new 3500, 4x4, SRW, HO, 6 Speed. I live in Bakersfield Ca. My Brother lives in Denver. When I got to Denver I first changed my drivers license to Colorado with my brother's address making me a Colorado resident. In order to bring the HO into California you have to do it as someone relocating to California not as a resident. If you try it as a resident with a new truck they will just tell you that you can't do it and to get it out of the state. I also changed my drivers license so that if I get stopped my license and reg match. My insurance card shows California address but WHEN he asks I will tell him that I'm working in Denver but that my wife in kids are still in California since the job I'm on is only about 9 months to a year long and that I wasn't going to sell my home and relocate my family for that short of a period. I plan on joining AAA and going there to change my reg. They are not near as anal about the fine points. You would need to have 7501 miles on the truck to dring it into California as a used truck. If it has less than 7500 miles on it they treat as new and charge you sales tax as if you just bought it here.

As far as the cab lights they are standard on the 3500 but are an option of about $70 on the 2500
 
Why not change the insurance card to match also? Could probably save you some major headaches if you do get pulled over!!:-{}
 
You have to leave it out of the state for 90 days. I have several friends who bought class A motorhomes out of state because they were a he!! of a lot cheaper and they had to leave them out of state for 90 days. Im not sure all the loop holes and hoops they had to jump through, but I know none of them went to the trouble to change their drivers licence and what not. I will ask my buddy when i see him and find out the exact details.
 
Why not just buy a SO and the Power Edge EZ to make up for the difference in HP? Oh, I don't think you can get the 6sp in CA, can you?

Can't get the 6spd with the SO. ;)
 
If you have a family member in another state register it with your name and his name on the registration and then do a dual registration [both states] and let the other state laps after a year. . did my first rig that way [with my Son as the other name in Nevada]. . sure ya pay a little extra but ya get the rig ya want



6 Speeds are available in Calif.
 
NO, 6 SPEEDS ARE NOT AVALIBLE CALIFORNIA!! You can only get the 6 speed with the HO and you can't get HO in California, believe me I tried

I had the opportunity to do just that but past on it, I bought a dirt bike from Canada and CA won't do an off road registration for it. Its not a DMV issue, its a CARB issue- California Air Resource Board advised DMV not to issue the registration cuz it wasn't "certified" for sale in CA. It was red flagged by the VIN# Doesn't matter that I bought it for off road racing only- no deal! I tried for 4 months to get it worked out.



I did get it registered but in another state and that states registration is recognized here in CA for off road ridding areas and racing events.



After that hassle I wasn't about to cut a check for 33K and risk all that sh%t all over again.



I know some that have done it in our area and the scoop is to get 7500 miles on the truck in less than 90 days. Reason is that the CHP will ticket you if the truck has been in CA for 90 days with no license and DMV will not give one up with less then those miles. I have heard of fellas putting them up on blocks and running them through the night to rack the miles.



I even thought of building a box to connect to the speed sensor so I could just turn the key on with engine off and run the box at 120mph each night for several days to get it done.



I bought here in CA and will put a box on it that will make the output even more then the HO.

Sure the HO is better but so will the next ones that come out and so on and so on. MY CA model does fine for me stock and the box will be just for fun anyway cuz I only pull 6000 lbs.
 
That is why I changed my drivers license. the rules are different between if you are a Ca. resident bringing something in and if you are relocating into the state. The DMV's stance is that if wanted a vehicle that you should have bought it here. On the other hand that is not something you are in control of if you are relocating.

True, and changing your drivers license made perfect sense when you have the opportunity to by having an address in that State.
 
Re 90 days or 7501 miles to bring into California

This post addresses only the sales tax portion of your question, not the issue about whether you can register a non-California-smog-compliant vehicle in California when moving in from another state.



Sales tax issue:



You need to look at Section 6396 of the California Sales and Use Tax Law, and Regulation 1566 of the California Board of Equalization Sales and Use Tax Regulations, section (d) "Out of State Purchases of Vehicles -- 90-Day Test. " You can find these at your local county law library, or if you have access to Lexis/Nexis or WestLaw, or you can consult an attorney.



Regulation 1566, Section (d) provides:



"(1) For the purpose of determining whether a vehicle which is purchased outside California is purchased for use in this state, it is presumed that the vehicle was purchased for use here if it enters California within 90 days after its purchase. This presumption may be rebutted by contrary evidence satisfactory to the board showing that the purchaser did not intend to use the vehicle in this state.



"(2) Prior out-of-state use not exceeding 90 days from the date of purchase to the date of entry into California is of a temporary nature and is not proof of an intent that the vehicle was purchased for use elsewhere. Prior out-of-state use in excess of 90 days from the date of purchase to the date of entry into California, exclusive of any time of shipment to California or time of storage for shipment to California, will be accepted as proof of an intent that the vehicle was not purchased for use in California. Accordingly, when a vehicle is purchased in a foreign country or in another state and is later shipped to California, the period of use for purposes of the 90-day test will be measured by the interval from the time the purchaser takes possession at the out-of-state point to the time when the vehicle is delivered to a shipping agent or placed in storage for shipment to California.



"This subsection applies with respect to vehicles ordered on or after October 1, 1970. "



This is what the big trucking companies do. They purchase a vehicle from a California dealer, but then take delivery of the vehicle outside of California and put it into service for at least 90 days before bringing it to California for further use. You can find a good discussion of how they do this in the case of Engs Motor Truck Co. vs. California State Board of Equalization, (1987) 189 Cal. App. 3d 1458, 235 Cal. Rptr. 117, which you can also find at your county law library. The law libraries are usually within a block or so of the main courthouse in your county.
