Help! 2007.5 68RFE shifting issues.

G56 not shifting when Hot

I have a 2008 Ram 3500 with 135k miles on it. It is starting to develop some issues with the transmission. The initial issue only happens after the first startup of the day. Truck goes into gear and will shift like it is suppose to until I try to stop for the first and/or second time, then it try's to not come out of gear. I can feel the truck trying to push through the brakes. After the initial or second braking it will not do this again the entire day. The second issue that I have noticed is that is the transmission is not partially warmed up, it will not shift into to 5 and 6 gear. I was leaning towards TC issues on the driving through the brakes but I read some other stuff that makes me question this issue, any Ideas?
 
My 2008 truck with the 68RFE trans will not shift to 5/6 gear when the trans is cold, it has been this way since new. I believe the TCM requires the trans oil to be above a certain oil temperature before shifting into 5/6 gear.

I have owned mine since new as well and the not shifting into 5,6 is something that just started in the last 10k miles or so. I did read about that on another forum a while back but seemed a little odd to me since ot had never done that befor. That was just a minor issue however, not coming out of gear when stopping just after the initial startup of the day is the one that has me stumped.
