JUPITER, Fla. -- A former Marine who flies an American flag in his front yard could lose his house over his refusal to remove his flagpole, which violates his civic association's rules.

The Indian Creek Phase III-B Homeowners Association has filed a lien against George Andres' home in an attempt to collect more than $28,000 in legal fees and fines a judge has ordered him to pay. Foreclosure proceedings are expected to begin in the next couple weeks.



Palm Beach County Circuit Judge Catherine M. Brunson sided with the association in June, ruling that Andres, 61, was violating its rule barring flagpoles. Under the association's rules, flags can be flown only from brackets attached to the side of homes.



Indian Creek attorney Steven Selz said Andres -- who continues to fly the flag -- and his wife will be interviewed to determine what financial resources they have to pay the association.



After the Sept. 11 terrorist attacks Gov. Jeb Bush and his brother, President George W. Bush, urged civic associations to eliminate regulations restricting the flying of American flags.



During a court hearing Thursday, Andres' attorney cited the Bushes when he argued that Indian Creek's regulation runs against public policy, but Brunson disagreed.



Barry Silver also argued that the association had committed a fraud against the court when it first said it objected only to the pole, but then later said it objected to the pole and the flag.



Brunson ruled no fraud had been committed.

Hmmmm, maybe call in a strike and take out the rest of the neighborhood???... . Did I just say that?? What I meant was maybe one of our national TV news or newspaper journalists would be interested in picking it up in these rather heady patriotic times.

You are quite right when you say no Marine should ever have the flag stripped. Lets go one further and say no american should ever have their flag stripped. Alas, I know not what we can do, but the previous thread states it quite well I think. Get the media involved. The conservative media, not the liberal media. That would be FOX news. Those people are real Americans. If they can't help then I don't know who could.

More to the point... Public opinion isn't going to help him. He needs a hand. A thousand of us, giving 30 bucks would do the trick.



I guess what I'm saying is: Time to ACT. I just don't know what to do. I have no money or otherwise... Only words... and those are cheap because supply vastly exceeds demand...
 
Even though I don't like the idea, I have to agree with the association. I see a lot of flags flying in a very disgraceful manner. O', they mean well you might say. Well, I might be right but I better be prepared to fight should I say something. In the end, would it be worth it? Morally maybe yes, financially or physically maybe not. Rules are rules.



This is typical of a home owners association. They pick your mailbox, your front door, the siding, the color, you name it. But, you need to understand going into this what you are buying. Mostly, when homeowner's violate covenents, they are warned first. I don't know, maybe not always. Go into a seniors only complex and start having kids, same thing.



This association has ruled and the courts have agreed. The system has worked. Not everyone is happy. Get on with it. Sell out and move someplace else.

24 hours after collecting the exorbitant, and unearned fines, the b@stards could file the same complaint right over again, because the flag and pole would still be there.



That's why, at the Gov't level, the U. S. doesn't (so they say) negotiate with terrorists. Unfortunately, he negotiated with them (either in person, or not) when he decided to live there. Somewhere, someone has his signature on a Nazihood ***'n document saying that he'll not be "different". He may feel like a hostage, but he's the one who gave them the permission to treat him that way.



He shouldn't'a moved to a place where he'd be subject to a "Nazihood Association"... . I avoid'em. I've got a little too much of the redneck in me to be putting up with their BS and would just end up dumping used Delo in somebody's petunias. That, although entertaining, would serve no good purpose, and some enviroNazi would then hammer me for improper disposal.

I don't like that kind of people, and, though everybody loves me :rolleyes: , they wouldn't think me to be "their kind". (which suits me juuuussstttt fiiiinnne!... . :) )

This is crap. The guy moved into the neighborhood knowing about the restriction or he didn't do anything to fight it when it came up before the association. He needs to remove the pole and display his flag in a manner that doesn't break the rules. Citing the Bush's is a joke, right?



The guy has made his own bed now he needs to sleep in it.

Rules are meant to be broken. Are they paying this guys taxes? NO If I were this guy I would strap the HUGE flagpole to the side of my house and say "now it is on the bracket on the side of my house. There are always ways to interpet the rules.

*That*, I like. I'd even be willing to drive there and help him bolt his flagpole to the bracket.



Hmm. What other re-inforcing would the wall need to support the bracket and staff? Would a 10' 4x4 top and bottom spread the load enough? Better yet, two 11' (to span all studs, assuming 16" spacing) triangular trusses top and bottom would supply all the strength needed to hold the flag pole. And it would be a true bracket.



Let's find him and build him a bracket for his flag pole!

What this has to do with patriotism is beyond me. Find something a little more worth while to ***** about. I'm sure none of you have ever had neighbors you wished would move because they're bringing down YOUR property value because of their choices in 'decor' - ie that '68 Impala sitting on cinder blocks:D

I don't care WHAT the rules were... I could NEVER complain about flying the flag.



Of course he bought the place. Of course there's a homenazi association... what of it? I'm ticked at the low down scum that complained... THAT's what i'm complaining about.



Whoever it is needs to relocate to a place they'll be more comfortable... Like Kabul.
 
No one is complaining about the guy flying a flag - the fraud thing sounds like lawyers taking things out of context. In fact, I'm willing to bet that plenty of his neighbors have flags flying on 'approved' poles. Also, when did the guy install his flagpole? Probably before Sept 11th if he's being sued for $28K in legal fees.



And why does it make a difference that this guy was a marine? For a profession based on taking 'legal' orders this sure seems odd. Would you all be offering to buy his debt if he was an anti-war protestor or naturalized US citizen born in Afghanistan?





This is not Berkeley with a ban on flags mounted on firetrucks - this is the one you folks should be *****ing about.
