..... take responsiblity for their own action? It looks like Ford is going to be sued because someone was driving careless. Last summer, 10 firefighters were going to Co. to help fight a wild fire around Denver. The driver reached for something and lost control killing 4 or 5 of the firefighters. Now it looks like it is Ford's fault for building the extended van because the roll over too easy. What a bunch of BS:mad:

This country is being destroyed from within by trial lawyers and a lack of tort reform. The true stories of the destruction of justice are rampant! McDonalds coffee spills, etc. etc.

Most folks either don't know or are complacent about the one critical component of American law: courts are charged to interpret the laws, not make them. A case like this would not get to court in Britain, where the loser pays all court and legal fees. This is ambulance chasing at it best, and it will not go away untill we all demand a change in our system of justice.

have you guys heard about the two teenagers who are sueing McDonalds because they ate there for years and just found out they are overweight? I cannot believe this... . No clue? Or just out to get a quick buck?

That's why we desperately need tort reform. There are locations in this country where trial lawyers try anything to locate their trials. These places have the most liberal judges and jury pools.

Here in Helena, a law was passed last Spring which forbad smoking in restaurants, bars and casinos, period. No non-smoking , separate areas, just plain no smoking. Well, this week, a judge read the law, and declared it un-constitutional. By the way, the average loss of business related to the law in these institutions was over 10 percent.

The law was quite simply an attack on the freedom of choice. If you don't like smoking, don't patronize smoking establishments.

If you choose to ignore common sense in your diet, eat at fast food joints. The point here is: we all are responsible for our actions. Lots of people seem to forget that, and I ain't ready to pay for their stupidity, whether by exhorbitant insurance rates or loss of my freedoms!!!!

Theres another giant sucking sound on America, INSURANCE companys. Believe me when I say, if socialized medicine ever happens, it will be the insurance companys that drove us to it! The lawyers and the insurance companys feed on America like a cancer.
 
Doctor's are bailing out of PA faster than rats off a New York docked freighter. Now we read about the state run pension system for teachers need to be bailed out by the tax payers.



Rather than help our manufacturers solve problem, the various agencies fine them out of existence or drive them to China. What is it going to take? Hey, brother, can you spare a dime?

Here where I live we had a drunk going the wrong way on a freeway. Sheriff's Deputy sees him and goes after him trying to warn on-coming traffic. Sheriff's Sergeant gets ahead of everyone, goes down an off ramp and sets up spike strips..... other patrol cars are in the correct lanes following along. Some gal who doesn't make sense of the police lights up ahead decides not to pull over and stop but GOES AROUND the police car into the open traffic lane which is just what our drunk does to avoid the strips..... SPLAT. Head on collision, innocent (but not bright) party dies. WHO DOES HER FAMILY SUE? The cops, of course... ..... because as we all know, "they intentionally directed her into that path of the drunk blah blah blah shouldn't have been chasing him blah blah blah" The county settled this for "purely economic reasons".



Far as I'm concerned, this type of crap should be tossed out and not even get brought into court. What a waste of my tax money defending this outrageous greed... ... .....

I WISH I COULD POSSIBLY AGREE WITH YOU MORE, BUT I CAN'T!!



This is as true as anything that has ever been said. CF, Ron, gibson QTRHRS: All you guys are right on the money-- LITERALLY.



Hmm, how is it that we have laws in every state the REQUIRES you to have car insurance? Could it be generous campaign contributions give to those in power who really know what's best for us? Didn't you know that we are too stupid to run our own lives?



On lawyers and insurance companies: It used to be they didn't advertise. They didn't have to, because people would seek them out when they were really needed. Now we have all the local ambulance chasers frothing at the mouth just WAITING to sue some big evil corporation (like a drug company, a restaurant chain, or automaker). This give the insurance scammers a reasons to jack up rates and laugh all the way to the bank (mostly car insurance).



This is all another power ploy. The goal here is socialized medicine. For years the elites have been slowly dumbing down the American population, creating this mentality that the Gov't is the saviour of the world. No job? We got welfare. Got cancer? Sue the tobacco company. Got in a wreck? It's the car's fault. Burn yourself ( I mean did you get burned by an evil coffee cup)? We will get you your day in tort, I mean court.



If we had REAL liberty in this country it would send this message:



1) you are free to not wear a seatbelt. We will not pay for your funeral or hospitalization.

2) You are free to not have insurance. Don't cry to me if you lose all you have because of (surprise) an ambulance chaser.

3) You are free to carry and use a gun. We are not responsible when your kid gets shot because you didn't lock it up.

4) You are free to smoke all you want, anywhere you want. We will not cover your lung cancer and emphysema treatments.

5) You are free to drink whatever you want, at any temperature. We won't pay for your burns when you spill.

6) You are free to to eat anything you want. If you get diabetes because you are 5'3" and weigh 400 lbs, Medicare doesn't cover that.



The bottom line is that you eventually have to wake up and realize that crap happens... It's not always someone's fault, and it CERTAINLY doesn't mean that someone owes you something. Get over it.



I think it's human nature to always blame others for our own flaws. But aren't our laws supposed to hold us accountable and bring to light our weaknesses, rather than institutionalizing the very worst of human nature?



I think we expect too little of ourselves.



One thing i love so much about the TDR is that this is one of the last bastions of those who believe in "BUYER BEWARE"-- the best summary of individual responsibility I have seen.



Since we in the TDR have all the answers, maybe we should start our OWN political party..... Me and Champane Flight can run it, since we agree on so much;)

I'm not sure we can lay all the blame on the lawyers and politicians.

It's like blaming the Columbians for our drug problem.

The "supply and demand" situation fits here too.



There are way too many greedy people seeking out these same lawyers every time they do something stupid, or are involved in an accident (Oh My neck!!:rolleyes: ).

America seem to have become a "Lottery" nation, where you don't need to study, and work hard to get ahead in life, you only need to find an attorney, then find someone with the deepest pockets to sue. :mad:

The lawyers are a symptom, but laziness and greed are the real problem.

Although slightly off the topic, I heard a stastic that 30% of adult americans expect to retire by winning the lotery.

I for one do not see an easy answer for our healthcare woes. The hospitals are being run by bean counters who have no desire to provide good healthcare, just make a profit. Nothing is wrong with a profit, but at the expense of the sick, elderly, infirm, and injured? The insurance companys are getting rich with no end in site, and everytime someone in power mentions socialized medicine, they launch a ad campaign that rivals the "end of the earth" scare. They continue to raise rates, because? Not because they are having to pay more out. Because they have lost some money on there other investments, like the stock market. That and the fact "that they can". They have everyone over the barrel and can have at it anytime they want, with the blessing of the goverment in most cases.



Socialized medicine? Well, it is a hard pill to swallow to. On one hand The doctors, nurses, and hospitals will not need high insurance premiums anymore. But there wages will most likely be paid in a set salary. We will have to wait for some elective surgery (which some should anyway) and even have some conditions put off until absolutly needed. But really folks, most of the horror storys we hear of other countrys woes on socialized medicine are put there by our insurance companys.



I know several people that are under socialized medicine and have had no complaints. Sure there are a few, but most have money and want things done now! With no waiting, and no idea what their medical treatment should be or what their condition is. And once they get to a doctor in the states, that doctor will feed them full of BS that "they could have died" from there condition. They love the cash customers!



I am paying for the poor and elderlys healthcare to be run poorly right now. It is the people that are working that are really in a hurt right now. I am carrying a insurance card, paying more and more for it. Along with my employer looking at the bottom line, cutting there pay amounts by 20%. The insurance companys sticking more and more for it and me only using it for dire emergencys (Half dead). I have only used my insurance once in the past year for a doctors visit and paid cash for it to lower the deductable. Everytime I go I have to wait behind a few welfare Moms to have their kid (with the sniffells) checked out for nothing.



Taxes are there and will be there for the rest of time, as long as we are a nation. We will pay! I for one would love to something for my buck. Right now the future looks bleak... . I was planning on partial retirement at 55, not after seeing what my insurance (or lack of) premiums will be... . Somebody else have an idea on how to rid the American people of insurance companys? Besides having a lawyer roundup?

I believe if the barritry problem is ever taken care of, the insurance company problem will take care of itself. UNLV, the level 1 trauma center in Las Vegas shut down after the doctors and staff quit, en mass, due to malpractice insurance rates.



A level 1 trauma center is where you go because you are hurt real bad. Unfortunantly you also have the specter that since you are hurt real bad, you might not make it, and of course that is never your fault. Then add to that the fact that there is a segment of the population that uses the Emergency Room as their primary care physician. Of course they are owed that care by the taxpayers. And then there are those evil rich doctors who should be sued just because they have cared enough to better themselves instead of leaching off of society.



As for socialized medicine, there are more MRI machines in the Dallas/Ft-Worth are than there are in Canada. The rich will always be able to go where they need (assuming there is time). The rest of us will hope we live long enough to make it to the care we needed.

I am real short-- supposed to be home Saturday/Sunday. Oman is getting really old, as are the 20-hr days of doing the dog and pony shows for the Colonels, and working the planes that seem to fall out of the sky at all hours. I miss my wife-- we were only married 2 months before I left. There's a guy here who has a 3-yr old he has never spent Christmas with-- he has been deployed for them all.



You know, it's funny how so many things seem to come back to tort reform. I mean, if it weren't for the outrageous medical malpractice awards, I don't think that the insurance companies would have rates all that high... . Heck, I bet a lot of doctors wouldn't even carry the insurance or need to.



I want to echo a thought listed earlier in this thread: THe problems is greed and laziness, and a feeling of entitlement. All these other jokers are merely catering to these vices.

WD: looks like I came in when you left. I came in on 12 Sept, so security was real tight.



I actually don't work on anything. I haven't since I was enlisted from '94 to '96. I am now the transportation commander here, or more accurately the LRS operations officer. Whatever. I run the vehicle and air trans functions for the base.



Lotsa rotators this week. Mine is Saturday. Tell my wife and my truck that I coming as soon as I can!

I could not believe they shut down UMC trauma. I did my stay there when I was an EMT trainee. I also was sent there after my run-in with a Kenworth. We had ski accident victims coming from Utah. Auto accident victims from Utah,AZ,CA, and NV. came to UMC. Many people will not get the proper car and many will not make it.
