You do own the data on your personal vehicle unless you drive a Tesla, then they have the rights to it. It takes a court order to get your data if you refuse to give it up. You can believe that they will get it in the event of a crash like in the video above.
I went to 4 days of Subaru training two weeks ago and they were unable to confirm if their "DriverFocus" system is also recorded by the EDR. The DrverFocus system uses a camera facing the driver and alerts if you look down or away for too long. In other words it records a drowsy or distracted driver.

I wouldn’t be interested in owning a car that has a camera watching me. I’m having a tough enough time dealing with the microphone on the mirror, and the phones, and Alexa as it is!
