Morning guys, im awake, im actually getting stiffer in my back(@#$%%) Im going to talk with the Dr. this morning and see if she can't just refer me to a physiatrist instead of wasting another trip to her office. This way i know for a fact at least with in some normal range and power of deduction if anything is wrong it can be picked up with either MRI or CT scan...

I received a call from the ins. adjuster about my truck. . when i bought that truck i never gave it a thought to have a carfax report done, he is telling me that in early 95 and nov. 04 the truck was wrecked, not sure what issues thats going to pose but i bought the truck in nov 05 and it has never tracked funny or anything, ran great actually, he said the 04' wreck is showing it was total loss... this only gets better, any advice. . I did tell him i wanted my truck either fixed or replaced regardless.

Most states have laws about vehicle titles stating "Totaled" or something to that effect. Mine says "Totaled - Reconstructed" if yours does not you might have to try and find out if what the adujuster said is true or not.

Yes, sounds like it'll be ugly. This is where you stop dealing with their insurance as they are trying their darnedest to not have to pay you anything for their client's accident that involuntarily involved you. You'll need to see what your insurance can do for you or lawyer up.

Wyatt... . I too am glad you are ok. Wrecks are bad even if you don't get hurt.

Not to take away from Wyatt... . But my brother was in a pile up. He was rear ended and thrown into another car who was thrown into another. Upon receiving insurance information from the person that hit him... they discovered they have the same crappy insurance company. The ins. co. is trying to give my brother 2/3 replacement of the car. They say that it is his fault he hit the other car in front of him. Any suggestions?

From what I understand, in a situation where the several cars are in an accident like you describe, that is the way it's handled. The rearmost car's insurance and driver are responsible for the one it hit and that is a domino effect on up the line. What sucks is that your insurance knows that if you try to sue for more with a lawyer, the lawyer's cut is usually 1/3 anyway so that's probably all you would get.

i figured as much. . The title i received when purchasing the truck was a clean title, had it not been i would have had an issue getting a new one here in Va. I looked at my title for the truck and it says nothing at all about such nor would i have bought a totaled truck either. I have made my other phone calls so we will see. And im scheduled for a MRI tomorrow i hope nothing else pops up.

Was not true in my accident but only 3 cars were involved. One rear ended my wife's car then she got pushed into me. The lady's insurance who rear ended paid for both of our vehicles. Was never a question.

Glad you are alright.

A very similar thing happened to my neighbor in his power stroke.

Shame.

IMO, the other party's insurance company is yanking your chain. If you have a police report showing him at fault, and you have his policy number, they do not need to talk to him. They may WANT to, but they don't HAVE to. When my husband and I lived in Michigan, I worked in an insurance office, so I know Michigan insurance quite well (Michigan is what they call a 'no-fault' state) but I'm not as familiar with other state's insurance.

What kind of insurance does this clown have? Something off of the internet, or an independent agent?

Good luck, and be well.

Website Policy - Reminder

WyattEarp, we are very sorry to hear of this bad situation. We're just glad you are OK, and it sounds like there is even hope for your truck.

I have edited a few of the posts in this thread. I have not removed anything factual about the situation. But I have removed references that were interpreted by several as racist. I do not think they were intended that way, but they were perceived as such. The bottom line is that an irresponsible individual hit WyattEarp.

Remember, TDR Members come in all races and genders. We want to keep this a website where all Dodge diesel truck owners feel comfortable posting.

If you have concerns with my actions, I'm available.

Thank you all. And please keep us posted WyattEarp.

Possibly i have missed posts or something while gone for MRI yesterday. Obviously someone has taken what i said out of context and assumed something something i said in the wrong manner. Right now just to let everyone know im waiting on MRI results, if anyone has ever exp. what i am with shooting pains in my head, severe dizziness and confusion with the inability to focus then u have been in my shoes.
My postiong of this event was for advice and to let you guys know what was up with me and the truck, nothing more. . To all i apologize, i have never had any issues with any member before and do not intend to starting now. Right now my only link to the outside world is my computer which isn't very long at times due to dizzyiness and not being able to focus and think clearly also i am not able to drive plus the dodge is still out of commission, im one to be on the go constantly and this is hurting me as much as the symptoms im encountering. Thank you all for your concern and prayers they do mean more than you will ever know.

Thanks
James

Hey guys, just updating my condition and what i found out with the other ins. comp. first off MRI came back showing no issues with my neck/spine, unfortunately that doesn't solve the issues im having, so whatever is the problem MRI either doesn't show or pickup. which im relieved in one way but not in another.

I got a call from some lady who how convienent was not in her office but called yesterday morning which i missed since i was laying down and didn't get to the phone, her comment was total loss and was *economically unrepairable* what crap is that, soon to be discussed on Monday i can asure you of that. The have no idea how important that vehicle is to the running of this farm etc...

Thought i had found 2 trucks, both have been sold so any leads would be great. Greywolf the truck out in Nebraska i believe to have way to much rust on the body and to far away but thanks for the link, emailed him and he said it needed a full body resto.

Thanks again for everyone's kind words and so forth, i am very much coming to the realization that my condition will be with me for some time, now i know what it feels like to be on a rollercoaster at carowinds and never get off the thing. Time to rest so things don't spin so much.

Hey everyone, wanted to update u on the truck and me. Truck they are totaling out, est. to fix from them 2274. 75, they valued it @ 2359. 75 im still going to chat with my ins. comp. going to call him tomorrow. Am getting my own est. done so i can get an idea if they are shooting straight with me.
Ideas? thoughts? all appreciated
As for me im being sent to a specialist to see if they can nail down the headaches and other issues. And now i know how pple feel that get motion sickness, im tired of riding and getting so sick:{
I did forget also they are trying to say my truck was total loss before with salvage title, she changed her tune when i told her i had contacted DMV in Richmond, Va. and the title when i bought it and the one i have now are clean. . so.....

As much as I hate to say it, lawyer up. Discontinue discussions with the adjuster and find a responsible lawyer. That is your best course of action at this point.

Long story short, my house burned down with a vintage motorcycle in it. The first offer was $1700 for the bike. After a month or so of fighting I got a check on the bike for $5900 or there about's. It was a restored BMW for what it is worth.

The way that I finally got them to acknowledge the value was by going to a BMW dealership and explaining the situation to a sympathetic manager who had experience in old bikes. He did a appraisal based on pics and documents that were available. This was then presented to the insurance company. I figure I still lost about $700-1000 in value but the appraisal was fair.

My advice would be to go to a dealership, (in your state) that specializes in diesel trucks. See if they can do something along the same lines?

In terms of the medical side, did you lose consciousness at any time? Just off the top of my head, I see it as likely your head bounced off the roof due to the impact damage on both cars. If you lost conciousness make sure you explain this to a neurologist. This will aid them in their assessement and that will dictate treatment.

I hope things get better. If you feel you have to continue talking to the insurance agency, you might consider contacting your states regulating authority for insurance. Don't be bashful in letting the insurance company knowing your intentions either.

Keep at it and things will get better!

Thanks guys, im up early got woke by pains in my head and usually im okay for a little bit until im either trying to move around or trying to focus on doing somthing(which really bites).
Flying gage i believe ur right as someone else mentioned, im done talking! which even makes my headaches worse. I do know regardless that truck/engine doesn't go anywhere, looks like im going to fight. . so be it!
Thanks again guys, well off to the recliner and more quiet time in the dark... And Wygate he had a individual agent which i tracked down. Sorry if im missing post and not responding, things don't click as they should.

I'm not sure what you think of Chiropractic care - but if an MRI isn't showing anything... . a good neck adjustment might make the headaches go away. If you decide to try a Chiropractor, I'd get a CD copy of your MRI and bring it with you - the going rate around here (Gloucester, VA) for an adjustment is $35, and if you already have an MRI, they won't try to soke you with the cost of an x-ray.

I'm a firm believer in chiropractic care, I don't think I could have made it thru my 2 pregnancies without it:eek:
