Seeping transmission fluid ?

Has anyone else seen a lot of low mileage 03's for sale

my last post was about overspray on the truck and didnt know what it was from. Took truck back to have it detailed and found out that the dealership had repainted the drivers rear quad door and rear dually fender. Hence the reason for seeing overspray. Dealer claims the truck was keyed on lot but did not not disclose the repair at time of sale. The truck is supposed to be all black and it is except that the door and fender are a different color black. Well known body shop has looked at the truck and agrees it is a different color and so does the dealership. I've owned the truck for 2 weeks and have made numerous trips to the dealership about the situation and they want to repaint it :mad: What do you think:confused: ?Thnak you in advance for your help.
 
I think that I would let them take their truck back and wait for them to deliver you YOUR TRUCK toy you. If there is any problem, tell them that ANY lawyer would have no problem representing you in court when you sue them because they never notified you that the vehicle had been DAMAGED AND REPAINTED BEFORE you purchased it... obviously a very underhanded business business practice... and I'm sure... very prosecutable too.

Thank you MarStock56 for your reply. I have spoke to the dealer about taking the truck back for another one but they claim it is the last of the 04's and cant get another one with the same features. Of course i did not try threating them with an attorney though.
 
Repaint

I would stick to my guns and make them give me a new whatever year 2004. 5 or 2005 truck as soon as they become available. THEY ARE THE ONES WHO MISLEAD YOU, NOT YOU. tHEY ARE THE ONES WHO MISREPRESENTED THEIR PRODUCT TO YOU, THEY SAID IT WAS A NEW, UNBLEMISHED VEHICLE, WHEN IT WAS, IN ACTUALITY, A DAMAGED VEHICLE THAT HAD ALREADY SUFFERED BODY DAMAGED A THAT REQUIRED REPAIR AND REPAINTING. Whatever you do, don't let them make you feel that you have to accept their pitiful excuses why they can't replace their vehicle with whar you paid for..... call Daimler Chrysler and demand satisfaction... call your state's Attorney General's Office and ask for their advice. DON'T BACK DOWN. YOU WON;T REGRET IT.

Thanks Mark S,I was looking for some other opinions and hoping that maybe someone else had been through this situation. Before i just start with a trial and error plunge. Does anyone one no if there is a dollar amount on repairs that a dealer can do before they have to diclose it on a sale?
 
if you are positive he did not disclose the repaint, he know he better find another truck if you want it. flip side is make him repaint properly and some sort of financial incentive if you like the truck otherwise. ie, all the goodies he can cram on there, lifetime maintaince and oil changes or something to your likeing. we all make mistakes but a bmw dealer here in alabama did the same thing and it cost him 2. 5 mil. i'm not big on lawsuits, but his error is just plain wrong. he can find another real quick if he has incentive.

The damge and repair has to be over a certain limint or they don't have to disclose. Lots of repaint/repairs done in the factory and after shipping. If it can be painted(which a qualtiy body shop)should be able to do it would be ok with me. They should have noticed to color differance before selling truck. apprently no ome looked close at the repair after. Or thought it wont matter!My last two new had to have paint repair,one got hit day before I picked it up. (baseball size dent)they discounted another $500 and fixed it. Looks normal/great. The other one(03 diesel)had a stain under the clear coat on left dually fender. Repaired and its not noticable that its been repainted at all. Has a little LESS orange peel to it in certain light REALLY looking at it etc. But no biggy in my book
 
If you like the truck and the dealer is willing to make it right, I'd get it repainted. If they can't make it right, they should get you a new truck, or offer you some cash back for the damage.
