Doug, Also research the PBJ (Probation Before Judgement). I have only seen it work on Speeding and blown red lights, I do not know about the reckless driving part. When you go into court they will ask you "Do you pleade guilty or PBJ" Go PBJ if you have a good driving record. My last two tickets the fine was reduced in half and points completely removed, and that is with a bad driving record. Both the tickets were in MD, Howard county and Forte Meade. Hope this helps. I had a vaguely similar situation where I did not get stopped, or get a ticket. The limit was 60, and I caught up with a string going about 52 - 55 (hard to tell, everyone was yo-yo'ing from the rig ahed of them) Anyway, at night, a LONG (miles) s traight stretch with no oncoming traffic, I pulled out to pass 2 or 3, and lo and behold when I get there, there's nowhere to go... so I kept it nailed to the floor and ended up going around 5 or 6 cars and a semi. Abouth halfway through it, a pair of lights appeared in the distance. Only the semi was following at a decent distance from the vehicle in front, but at 100 MPH, I had to brake REAL hard to get into the space. I swear there wasn't a length of my truck between a couple of them, and the guy following the semi. Why nobody else passed, I don't know. There was lots of opportunities before I caught up with the string.



I'm sure a county mounty or state trooper would have been having a screaming fit to catch me on radar at 90-100 mph, but like you, once I pulled out, the gap I left closed and there was nowhere in front, either. What appeared to be a large space ended up being a small car between two 1 tons pulling horse trailers.



WAshington state specifically has it written into law that you may exceed the speed limit to pass someone. I believe Oregon does too.
 
I agree with fighting it.



Be very clear when addressing the judge.

Judges check people for BS and make quick judgements as to character.

So...

Make sure the first 2 sentences you say are absolutely true & prove your side. Be respectful but strong with those first 2 sentences.

Take pictures of the road which prove your story.



I got a "Careless & reckless" citation one year, for pulling out and passing a slow-moving garbage truck under similar circumstances. Cops make flash judgements, and once they decide to give you a ticket they won't back down.

I pleaded innocent and went to court, (this was in Kansas City), and God Bless America... that year the Chiefs won the superbowl and were due back in K. C. on the very day of my court appearance! Cop didn't show up! :D

Case dismissed! :D
 
FFutch, if you haven't plead guilty to anything yet. GET A LAWYER.

No guarantee you'll win. But when your in court, your in their playground. Shop lawyers. Use one who knows the judge, been in his courtroom, has donated to his election campaign, etc.

If you win, you probably haven't saved any money, but you've

saved "points" and the tickets aren't on your record. Good Luck
 
Before hiring a lawyer, call the prosecuting attorney's office and see if they'll do anything. I recently received a driving award from Missouri's finest while on a motorcycle. I called the prosecuting attorney's office and they reduced it to a defective equipment ticket with no points(but double the fine!). I was a lot more willing to pay the higher fine since I didn't have to pay a lawyer also! Some jurisdictions won't deal directly with you, but some will so it's worth a call to find out.
