I've accepted settlement

just to update: Settlement without going to court has just about accured, I've accepted on my side, just waiting to sign final papers from Banks and my Lawyer, with return of the Banks product they will reimburse the cost of the kit, and cover my other out of pocket expenses. They have also included a portion to cover lawyer fee's. I've made it out of this "ok" and my lawyer has not been to costly and he's also nice!!!!



by the way I've recently installed 275's Luv'em,,,now that this is about over whats next,,,,,,EZ,,,,etc. etc... Oo.
 
of course not!!!

If a company states in writing and promises to stand behind there products then they should, that is what this Banks issue is about!!!
 
I Know. It's one thing to stand behind your product But to do it in a manner that can mislead ... . ehhh... . then the line is crossed. Me I loved my banks kit but wanted more ..... so I did.

Good for you. It is too bad that you had to get a Lawyer to make them stand behind their advertising and warranty. Still it's too cheap for Banks, I am sure they have gotten more benefit from their phony warranty claims than it ever cost them. Only a few consumers will go as far as you did to make them back up their claims. Again congratulations, it is people like you that make it better for the rest of us.
 
It's Final

After many months, I have the check in-hand from my lawyer ending the issues with Banks, All of my out-of-pocket expenses were covered including the lawyer fee's, keep in mind that no-fault was ever admitted, also since I started this case against Banks, I've noticed that thier advertising does not indicate any longer that their equipment does not void factory warranty so by pushing this, maybe I have helped others. ( I hope):) :cool: :D Oo.

Glad to hear that it is over with bank$ and they've removed thier FALSE ADVERTISING about NOT voiding your warranty if you install their products.



I'm sure bank$ knew exactly what they're were doing and I'm SURE many many folks had to eat the cost of losing their warranty from failures CAUSED by BANK$ products.

Charles, you unfairly make it sound like Banks products cause failures. Sure they might but so will ANY power enhancing upgrade. None of the others will keep your warranty intact, Banks just joined the club with the rest of them.

Bill, Yes that is the case because bank$ has been saying for all these years that their products "doesn't void the warranty. "



None of the other high performance companies making fueling boxes, injectors, and turbo advertise that it does not void the warranty.



Also, they (bank$) expects the user to pay the cost (court, lawyer) to provide the burden of proof to get their money back from bank$ should there be a warranty claim that is denied.



My comments are unfair, but don't you think their FALSE ADVERTISING is unfair too???

fj40charles,,,,,you explain my case very well,,,,while I at the time had my head in the sand, I purchased the Banks kit due to them indicating that their equipment did not void warranty. This was before my days with TDR!!!!!
