Sounds like the Dealer, with the blessings of DC, is trying to keep the truck from being labled as a lemon/buy-back. I would go there and find out what they are offering, it won't hurt, and you might get what you want. Don't burn a bridge that may be a one shot crossing. Let them make the offer, with the letter writing saved as back-up, and see if you can come to an agreement. They are a bussiness and will look at this as a cost of doing bussiness. You give them an out, they agree to your terms. Everyone wins. MY 2 cents. Mike
 
SSAge, settle for nothing, its a tough market out there and competition for dealers and manufacturers is pretty tough, none like to loose a customer, attny consult is free. Park it on the street

with a picture of a lemon on it, you may even get some local press. Been through similiar experience with GMC years ago. DC should swap evrything over. If it is not a match or doesn't fit DC will replace items. DC will always try to get you to be happy the cheapest way they can. Stand tall, they blinked when sai d they will do this if you don't use the lemon law.
 
If they do a strait replacement vehicle, MSRP for MSRP like they did on mine, your current loan will stay intact. Nothing will change.



They will do a change of collateral with the bank. New vehicle title for old and you just continue on with your normal payments.



This is how mine worked out.



As far as milage goes, IF they decide to charge you anything for mileage, it is only up until the first time it was brought in for the issue they can't resolve.



As I mentioned before, try to work it out with the dealer / factory rep first, but don't let them try and B. S. you at all.



Last choice should be an atty, which again, do your homework and get one with a strong reputation for lemon law cases.

I used Krohn and Moss (yourlemonrights.com) in 2000. Paid nothing and got what was fair. Everything was handled over the phone and snail mail. Don't let this dealer put this on his lot. How would you feel if you spent your hard earned money on this used "lemon"? The AC problem wouldn't come up during a test drive or inspection.
 
Go on the internet and find an attorney that deals in lemon law buy backs. The manufacturer by law has to pay the attorney so it's free. A freind of mine did this and got a brand new 750 BMW just because they couldn't fix the auto tire inflater. He had over 12000 miles on his car and didn't have to pay one cent for the new car or the attorney.
