Justice system sees killer as another ‘victim’


I just read a column un the Vancouver Sun by Fiona Flanagan on the subject “Victim hood”-how it has permeated our society to the point that responsibility and accountability particularly in our justice system, has very little meaning any more.

I then read an article in the Abbotsford News, which I consider to be a classic example of what Flanagan was referring to.

Court of Appeals judge Jo-Ann Prows granted Sonny Toor; a convicted murder accomplice, bail and gave the following reasons for doing so: That releasing Toor would not harm the public interest as his murder participation was “spontaneous” and his grounds for appeal are not frivolous. That there is no indication that Toor was otherwise prone to violence.

According to the learned judge, Toor didn’t play a very important role in the murder.

Why heck, he just drove the car to the scene of the murder, waited and then drove the triggerman away and helped him dispose of the weapon. Does that sound spontaneous to you?

The judge seems to be suggesting that Toor is really not that bad. And in other words, he is just a “victim” of circumstance. He was simply in the wrong place at the wrong time and got talked into doing something he normally wouldn’t do.

Therefore, a second-degree murder charge was just too harsh in Judge Prows’ reasoning. Accountability and responsibility aren’t even a consideration.

What is also missing in this report is our justice system’s responsibility and accountability to the true victims of this horrendous crime.

This judge seems to be genuinely concerned with the severity of the sentence to Toor while saying nothing at all about the suffering and pain of the family of the true victim.

Maybe Toor didn’t pull the trigger, but he willingly and ably assisted, which makes him just as guilty.

I very much disagree with the judge’s assertion that his grounds for appeal was not frivolous. This man was mixed up to his neck in the murder plot and, in fact, got off lightly with a second-degree murder charge.

In our convoluted system of justice, there is little evident concern for those who have a crime committed against them, but a great deal of concern over absolute fairness to those who commit crimes.

As I read your post, I had this sinking feeling in the pit of my stomach that this might be the case #ad
The people in our society that want to conduct social experiments at the expense of justice, I believe will answer for this someday. When God handed down the laws of justice, how to run a country as far as dealing with crime, "An eye for an eye," etc. , he was trying to show us that when the people are no longer held accountable for their actions and justice is denied to the people, chaos will soon follow. I see that it is not just the American justice system that has fallen to these perversions but appearantly this is happening everywhere. Bill, I can't really get the words right to say what I feel about this, the mixture of sadness and anger but all I can say is my thoughts and prayers are WITH you and yours and AGAINST these criminals and their accomplaces in the legal system who pervert justice.

Sorry to hear about that Bill. I truly find it $crewed up.

Though from experience, I do have to say that the justice system is here to benefit the criminal.

I am a hard liner!! If a judge releases a criminal, for any reason and that criminal is involved in another crime that person AND THE JUDGE goes to prison.

With as many good people there are in this world, why do we have the obligation to try and re habilitate the scum bags who do not wish to be rehabilitated? THOU SHALL NOT KILL is about as simple as it gets.
 
the court system, as originally devised and designed, did not contain the defense attorney in order to "get the accused off". The defense's responsibility is to ensure that "due process" is observed. When this is adhered to, the appeals, if any, are less likely to overturn any conviction. Somehow, the defense attorneys have lost sight of this. More unfortunately, many of the courtroom lawyers have been elevated to judgeships. I hate it. the O. J. trial, and a few others, have been astounding examples of a focus being lost, and a purpose being obscured in the convolutions of procedure that's become unnecessarily complex. For the times when opportunity allows, shoot (fatally!) the perpetrator while he's perpetrating, and let the chips fall where they may. God, if not a liberal system, will be on your side. --rich/a. k. a. "geddy's uncle" aka MoparzMo'Betta! (depending on where i'm posting)
 
... . I think the key here is to remember that both north and south of the border, the 'system' in question is not a JUSTICE system but a LEGAL system.
Keeping that in mind makes it easy to understand why these events that surpass all human understanding occur almost daily!

I am Embarrassed... . to hear about our justice/legal system. The charter of rights and freedoms gets more traffic from the defense attourneys instead of the victims.
I truely don't understand how that can happen, it becomes a catch-22 doesn't it?? If you avoid infringement on the perps rights, don't you trample the victims rights??
The way I figure it is. . You forfit your rights as a criminal. You should have no rights as criminal if you ultimatley took someone elses away. Now the innocent till guilty crowd will start their rant here...
I just wish for once, the victim got all the attention and help instead of the criminal. We have some nice wilderness up here to keep those buggers busy plantin trees. You know, doing something instead of wasting our money watchin TV.

Bill I missed out on what your particular trauma was, and not asking to know either. I just pray for all who are victims of crime and hope that this criminal haven (Canada) realizes how bad it can get as our population is growing.
