Ok, so I bought my 2001 New in Oct of 2001 for 30,500. 00. The original MSRP was 38k with an added markup that brought it to around 43k. It turned into a major fiasco with the dealership and they were all ****** off cause apparently they lost 1900. 00 on the truck, that was after the money they also made on the extended warranty. It was just after 9-11 and nobody was buying anything, I assume that's why I got the deal that I got. Anyways, it was a big ugly situation where they tried to get the truck back from me after a 10 day "right to recind" that had expired and I told them to pound sand cause I had already lifted it, wheels, tires, stereo (which I waited to do till after the 10 days). Anyways, they had a problem with the financing cause I had too many vehicles financed at the time so I ended up trading one in (which they had to give me pay-off for that ended up being a lot closer to retail book than trade in book but their hands were tied)

Ok, so they charged me 2420. 00 for a 100k, 7year warranty through AN GOLD? Well I have 60k on the truck now and I know that they won't cover many issues now due to mods so I figured I should cut my losses and request a prorated refund.

I go to the dealership to do it and they need my VIN to get the warranty info. They check it and then tell me that there is no warranty on this truck! I say that there is and I was charged for it. They ask for a copy of my original sales contract and I say I don't have it. I didn't tell them that I was looking for a refund, I was just inquiring who the warranty was through cause I knew it wasn't DC. They say that they have to retrieve a copy from storage and they will give me a call tomorrow when they get it. That was two weeks ago and I have recieved no call.

I was talking to buddy that used to be in the "car business" and he says that because of the loss they took on the truck, they probably never purchased the warranty in hopes that I would never need it but charged me for it to offset their loss. He said I should be entitled to the entire amount since the warranty was never even purchased.

I figure that if I make a stink with no proof then they will just say "oh, here it is" and either purchase it then or ask what my issue is so that if I say I want a refund then they prorate what it would be. Basically, they charge me $2420 for nothing and refund back $900 or whatever for their little scam.

I don't know what I should do here now so any advice would be great!

Sorry for how long this is but I wanted to make it clear.

That sounds ugly. I had a problem with the warranty on my truck when I bought it used, took 6 months to get it straightened out.

I'd get a lawyer involved and raise all kinds of hell about it.

Just my . 02

What is this "right to rescind"? Do you mean to say that the SELLER has a "buyer's remorse" clause in California? Never heard of such a thing!

What is that word again that we can't use in reference to "dealers" like this? Dang, I can't remember... . sure did seem to fit in this case though.

Anyway, if you have documented proof that you purchased the warranty through the dealership, your rear is covered. However, it may take a lawyer as was mentioned before to push the issue. Sometimes though, a simple talk with the General Manager can resolve these things, especially if he has the idea that you may challenge the "dealership" (I still can't remember the other word) legally.

Basically, they approve your financing based on your credit at the dealership assuming they can have the contract "bought" by a finacial institution. They didn't see a problem as my credit was great and my income to debt ratio was fine. They ended up having a problem due to the fact that I had too many vehicles financed already (one was an existing loan on the truck that I drove before I bought the Dodge that I was going to sell. ) I ended up having to trade in one of my vehicles for DC to accept the financing.

They have 10 days to get your financing "bought" or contact you to return the vehicle. I'm just glad I knew my rights.

I found the original sales contract that shows the purchase of an extended warranty for the amount of 2420. 00! ;)
