Absolutely, mine is in the shop for it as I type. The Cummins warranty covers motor, fuel system, and a few other things.
Get it fixed, and don't take NO for an answer, that code means the death of the pump (sooner or later) and they will most likely try to jerk you around.
Mine has been covered under the 100k warranty, and I had no code. It is STILL in the shop waiting on a pump..... Took it in last monday... . SHOULD be done today, provided the pump comes in. But the shop offered to pay for my rental so all is good, dealer has been pretty good to deal with actually, for a vehicle I did NOT buy there, they are treating me alright...
On the VP44, its not like timing on the Mechanical pumps... I mean. . the pump has to be timed, but the ECM (ECU) controls the timing using a solenoid and charge pressure. . In this pics its at the right of the pump housing. . but its on the bottom facing forward. .

Below, hanging off the bottom of the pump control unit housing (PSG) is the angle of rotation sensor... This basicaly tells the controller the timing of the pump. .

The angle of rotation sensor reads off the... gear. . teeth on the shaft. . the two little screw sticking up is where the angle of rotaion sensor would be mounted. .

I've got 139k on my 01 and am holding my breath about my IP. Is there an performance pump out there that will hold up better than the original and where is a good place to buy them?
On the timing... they are probably going to clear the code. . and if it doesn't come back. . they'll tell you to drive it more...
On the performance pumps... Piers was selling a "Hot Rod VP44" but I haven't heard anything about it in a while, there are a few members running these pumps. . But I don't think there is a pump that is going to last any longer than the next.
Someday I'll come to that point... (146K now. )

Edit: I also see that Blue Chip has an aftermarket pump.
well last fri. nite i was coming home from work and my truck just died and wouldnt start! So i rolled into a parking lot and left it there till 1 in the morn I went out with my dads 00 CTD and towed it home. I waited till one oclock so all my chevy lovin' friends wouldn't laugh at me the whole way home? : ) next morn went out and crank it 3 or 4 times and it fired up and has run good the last few days. I didn't know if it was a sign of my pump going out or what but I just dont want to be left sit in another state sometime!
