Chad - you make some good points. Drunk, burning w/in city limits etc. Arrest the guy for things that are against Indiana laws that DO NOT violate the Constitution. If the guy wanted to make a big stink about it I'm pretty sure the prosecutor would drop the flag burning charge w/o a press conference.



I guess I can't have a campfire w/in city limits:D

No where in the constitution does it say you can/cant burn a flag.



There are exceptions to every rule depending on the circumstances involved. That is why we have phrases like justifiable homicide in the legal system. Murder is murder, but some people have it coming, and the Courts along with the rest of the legal system understand that.



If you get thumped while burning a flag, dont expect any prosecutor (elected office) to allow charges to filed on your behalf against your assailant. Its called selective prosecuting, and it has been going on for centuries. Part of the exceptions to rules thing.



Down in North Carolina where I lived once, there was a law still on the books for that county, that was very interesting. It was from the late 1700's I was told. It stated that a man could legally beat his wife in public as long as he did it on a Sunday, at noon, in front of a Magistrate of the Court, and with a stick no longer than his arm or bigger around than his thumb. That would be a good county to live in!

HDH - You're correct but it also says 'in a dignified way'. That may be subject to interpretation, but I would bet the standard for 'a dignified way' is pretty high right now.

My Thoughts

I just thought I would add my 2 cents! I spent five years of my life serving this great country, and everyday on any military installation 2 things always happen. In the morning and again in the evening the flag is raised and lowered. During these times everything stops! I can think of nothing that I enjoy more than standing at attention saluting the flag during colors! I have been taught all my life of the importance of the flag and what it stands for! As I am sure MOST of you understand, many thousands of lives have been, and will be, lost fighting to defend this way of life. IMO the disrespectful burning of the flag should be against the law. Unfortunately, it is allowed by the constitition at this time! I will say this, I support the constitution and I am glad it is in place. I will not, nor will anyone else disrespect the flag in my presence! I say pi$$ on being politically correct! If I see it and I can do anything to stop it, within reason, then I will! You can call me whatever you wish, but above all I am a Patriot and always will be! As for me and my family, We choose to be Americans! If you don't like it here, GET THE HE!! OUT!!!!!!!!!!

While in the Navy I volunteered for color guard, and was always moved and honored, especially during evening colors, when we folded the Flag.

I hear you. Needed another flag and couldn't find one anywhere. So my daughter (a soldier) asked her boyfriend to find one. He got one that was flown off an Army tug boat (how many people know the Army drives tug boats?) They brought it up to me last weekend. She wouldn't retire it without a full ceremony complete with a folding worthy of a burial ceremony.



Six months ago she was a high school senior worried about whether her prom shoes matched her dress.



Go figure.
