I'm in as well. I also still owe $20 to whoever set up the fund for PowerWagon's truck. I lost the address and I don't remember who collected that money, but PM me and I'll send you a check. I know it was about a year ago, but better late than never right? I just remembered about it, I am so absent minded... what was I talking about?
 
Maybe it would be better to pool the cash and hire a great lawyer. If members bought them an engine DC would win by not paying the tab, if they are forced to pay for it that would make a win in the right direction of consumers.



With everyones donation I'm sure a very smart lawyer could be found to handle this. Does anyone know how to reach Johny Cochran?

Add me to the list!!!!!!!!! Paypal would be a good idea too. Tdr should have a ongoing fund for things like this. I would pay $5 more a year for registration to supply the account. And maybe poll the members when time to distribute the funds? Just a thought.

My thoughts exactly. When this thread first started I read a few posts and had mixed feelings. This thread shows the kindness and willingness to give by many, which is strong statement about the fine type of folks the TDR is comprised of and one of many reasons I enjoy being a TDR member. I just thought the attempt to raise funds was for the wrong reason. In my opinion its a matter of principle. DC needs to be liable for the product they sell and held responsible to its customers. If whitenight's folks use the funds to relieve DC of warranty obligation it just helps re-enforce DC's way of thinking on how to treat customers with warranty claims, "jerk 'em around long enough and they will go away".



Last I read about this saga was whitenight folks where doing things in the proper order and taking this issue to arbitration. So there still is a chance DC will step-up to the plate and take responsiblity without this turning into a court matter. If not I think with the support of 14,000+ TDR members on whitenight's parents side DC should get the message we will not stand for this type of treatment to fellow Cummins dieseler's :mad:

#2. Perhaps TDR administration could set this fund up and handle it.



#3. Let's get them the engine first and back on the road... ... . Then get the lawyer and take DC to the galley.



#4. After kickin' DC's posterior replenish the fund... ... and use it for other such cases... ... ... . You don't think this is the first and only time this has happened do you?



#5. This can become a VERY powerful club... ..... 14,000 plus members... ... ... if we ORGANIZE ourselves we will be heard and DC perhaps will show us some respect... ... . WOW... ... . what a concept. There might come a time when DC asks us for our input on future features and design... ... ... .

The Whiteknight Proclamation...

I'm in. A TDR fund for just such a thing (battling D/C to fulfill their warranty obligation) is a good idea. This can become a renowned(sp?) fund. "The Whiteknight Proclamtion Fund. " Or some such name.



What kills me, is that the warranty claim is rejected yet D/C DID NOT even determine what the actual root cause of the failure was. They just said, "its the oil filter. " Without any proof, and warranty has been rejected for only that reason. And that's why I think D/C should be forced to pay. The fact that they can so easily reject a warranty burns my a$$.

Don't yell at me but it might be a good idea to try and get the "other" CTD websites in on the Lawyer fund deal.

This proposed fund thing has been kicked around before but that was about all that came of it. I can see some issues which would have to be addressed like: How would it be set-up? Who would manage the fund and most importantly who or how would it be decided what cases to use the fund on. I'm thinking the best route would be when a case (such as whitenight's) comes along the TDR admin would need to post a poll and every member could vote on whether or not they thought it would be appropriate to use the fund for the case at hand and how much $ of the fund would be appropriate to use. In the case of whitenight I think any good lawyer would be able to recoup lawyer and court fees from DC, which would be hopfully re-routed back to the TDR fund.



This fund is a good idea, but I'm sure it has lots of potential problems. I can already foresee lots of :-{} from members complaining of mis-appropriate useage of "thier" donation, those who do not contribute should not have access to the fund, why is it when they have problem they don't qualify for the fund they contributed to, etc. Things like this will more than likely lead to the funds death. I think some very strict and specific criteria needs to be established on what qualifies for use of this fund. The TDR motto of "I am my own warranty station" will need to be stressed and clearly understood by all, because things like mechanical failures resulting from BOMB's should not even be considered.



I'm sure there are probably many more TDR members who don't bother with the TDR website or have computer access, so they would need to be informed through the quarterly mag. Maybe TDR admin could take donations and even have an option to chip in a buck or two when you re-new your membership.
