First timer, 2004 fuel & charging issues

I have a friend who has an 07 5. 9 with 65k on it took it to the dealer for loosing oil, the took apart the intake and found dust in the turbo and a fram air filter #@$%!(I know not good), now dealership will not warranty it. Their District Manager is the one that made the call. What are my friends options, He has already talk to customer support. Let me know what I can tell him. :confused:
 
Well the truck is "black balled " with Chrysler. This is sad. Who installed the filter? Did it leak around the seal? maybe he could go back on Fram just an idea. Keep us updated
 
Bad news. I'm surprised how many folks will buy the best light truck with the best diesel engine on the market then have them serviced by quick lube shops on the corner next to Wal-Mart using cheap non-approved filters.

I'm afraid your friend has two options. A new engine purchased from a Dodge dealer parts department and installed by dealer techs or a Cummins rebuilt and warrantied engine purchased from and installed by a Cummins dealer.

Personally, I'd go with the Cummins rebuild.

He could probably spend a bunch of money hiring an ambulance chaser and trying to sue the dealer, Dodge, or Cummins but he won't win the lawsuit.

I had my name changed because I actually work at the dealership. I just found out he filed a complaint with the Attorney General and Named me and the service manager as trying to take his money. He took it to another dealer and tried to slide it through and that dealer had the same regional rep. I am a little disappointed. I was trying to help even was trying to find a cheaper rebuild and this happened.

The state AG will probably ignore his complaint and send him a standard form letter but even if they investigate, which I doubt, the dealership will explain the problem to the silly bureaucrats and end the problem. He'll still get a standard form letter from the AG. I hope the dealer service department or the Dodge rep was smart enough to photograph the important details.

Next he'll probably find an ambulance chaser who will tell him "sure, just give me a couple thousand bucks up front and we'll sue the dealer, Dodge, Chrysler, Cerberus, Daimler, and the UAW and make millions. " In the meantime the payments will still be due on his truck and it will still be parked. The lawyer will eventually blow him off after taking his money, if he even has it to pay the lawyer.

The moral of this story has been told and repeated here in TDR for eight years that I've been a member: Use ONLY Fleetguard or MOPAR filters, and high quality brand name lubricants and follow the recommended service interval. It works every time it is tried.

First, I am confident that your negative degrading post are not appreciated by the majority of members of TDR if not all.

Second, what do you know about practicing law? Your ignorant comment about the AG and about lawyers and how they work and treat people is illustrative of your ignorance. You have no clue how a law firm works or the difficulties faced in a small firm which are the firms that typically represent plaintiffs in personal injury and civil claims that you illustrate in your post. If you came and worked for my firm for 2 weeks I bet you would change your mindset and stereo types of attorneys.

Oh by the way the CAPN Harley, who works for the Dodge dealership should have his warranty voided too on the 2006 in his signature (stage 2 AFE ). So everyone knows what filters are supposed to be used?????? Capt Harley doesn't or he doesn't care that the measly gains in performance from an air intake and aftermarket filter will void his warranty. I hardly believe that Captin Harley who works for Dodge would void his warranty for gains that are not even noticeable Even if Capn Harley's truck was out of warranty I hardly believe he would take the risk of destroying his 10,000. 00 motor for the gains accompanied with an aftermarket filter and intake unless he doesn't feel that there is a real risk of an aftermarket filter being the culprit if engine damage.
 
I sometimes agree and sometimes agree to disagree with Harvey... . But I don't accept your striking out at him... . this after all is just a forum of people writing about their trucks and their concerns...

I suggest that the owner of the truck contact FRAM, they after all guarantee their products to meet or exceed the OE standards... . if this is the case and the written information they publish is worth the paper its written on... he might have some recourse.....

There are some on this forum that I don't agree with... and I just don't bother to read their posts...
 
CAPN Harley, was it a “stock” replacement paper filter or a performance or cleanable type filter?



Considering how dirty my turbo looks (always use stock Fleetguard filters, changed regularly and with no signs of seal leakage) I’d like to see how dirty this turbo was. Is there a picture of this turbo? Where is the line between normal dirt and excessive dirt?

Seriously, this issue comes up from time to time and it would be a great help to everyone to know where the line between normal and excessive is. Does the color or texture of the dirt matter? Does Chrysler give specific instructions on diagnosing dirt on the compressor wheel? Even better would be if there was a picture chart, like is done for reading spark plugs.
 
I discussed this with one of my clients who is a diesel tech for a local dodge dealer and he said he has not seen them void a warranty over this. He actually stated that some dust like material is not uncommon.

It sounds like you are one of the ambulance chasers I described above. It means nothing to me for an ambulance chaser to call me "ignorant. " I consider it an honor to have an ambulance chaser calling me names. I'm rather proud of it now that I think about it.

I know enough about ambulance chasers and law firms to know that this story will turn out exactly as I predicted. I also know enough about ambulance chasing attorneys to know I wouldn't hire one.

Similar incidents are reported here on TDR from time to time and the result is always the same. I have a good personal friend who is a mechanic and was formerly a mechanic in a Dodge dealership. He has told me stories of seeing exactly the same situation in the dealerhship he formerly worked in. Use aftermarket parts, experience engine failure, warranty is voided, owner pays.

In the future, if you disapprove of my opinions don't read them. I'm thinking of a couple more suggestions for you, but won't post them here.
 
I understand dodge/cummins has to draw the line at some point or people would be taking them to the cleaners but it seems to me that some provisions to the warranty coverage could be considered. This is just my personal opinion and feelings.



I feel as if the totality of the circumstances should be considered when making a decision such as voiding or black balling ones warranty on such an expensive vehicle and motor. A situation such as this, where there is no evidence of performance modification, clear negligence, or neglect of maintenance on the owners part should be given further investigation if not there needs to be warnings clearly marked on the vehilce near parts that are commonly replaced as part of proper maintenance especially if Dodge/Cummins is not going to replace the maintence items under warranty, which would create an incentive for the client to return to the dealership so that proper replacement parts can be installed. Numerous people who purchase these trucks either perform the maintenance themself or take the truck to a shop who specializes in light maintenance and more than likely neither are aware that the replacements they use for air filters could void their/customer's warranty.



Voiding the warranty of a vehicle that has not been neglected, modified, or suffered due to the owner's negligence, but simply for alternating the brand of a commonly replaced maintenance item with that of a well established competitor brand will hurt the client confidence in Dodge/ Cummins. I think it is safe to assume that none of us on here would wish that to happen especially given the hard times the auto industry is having.

Actually I have hired a couple of attorneys along the way and that is the reason for my opinion of lawyers. I owned rental properties for almost fifteen years and although I owned and maintained nice family homes and managed them professionally, it is inevitable that landlord tenant disputes will occasionally arise. Several years ago I leased a nice older home to a young divorced mother of two small children who was a first year med student. I liked her and admired her for what she was doing. I was kind to her but when she vacated at end of lease I withheld a part of her damage deposit for damage she had caused. It was unquestioned and I had both witness and proof, she simply thought I should eat the damage and cost of repair. She was indignant and demanded her money. I followed all the rules but she eventually filed suit in small claims court. I didn't know an attorney for that type of law and hired one from a list provided by the jp.

The lawyer I hired was and still is a scumbag. He knowingly and deliberately took my retainer knowing he was going to collude with the opposing attorney. He drug the case out for months postponing the trial, demanded another fee then another. He and her attorney were simply milking me. While this scumbag was representing me his name and a story appeared on the front pages of the local newspaper. He had taken advantage of a wealthy older lady and stolen close to $100k from her or her estate. He was sanctioned by the state bar.

Ultimately, he sent me another bill for doing nothing and I'd had enough. I sent him a formal letter refusing to pay, demanding return of the fees I had already paid, and threatening to take my case to the TX bar.

He swelled up like a hotshot lawyer but folded like a cheap suitcase. He cancelled the last bill, returned a small portion of the fees I had paid him in return for my signature on a release. I settled and hired another lawyer who immediately negotiated a settlement and it ended. Still cost me lots of money for nothing and the girl never got a dime of her money back. I regret to this day that I didn't tell my first attorney to shove it and take it to the Texas bar. He should be disbarred.

You are probably a hardworking attorney struggling to make a living and are probably principled and fair but you know better than I do that many of your peers are as I described. The lawschools are selling too many diplomas to too many young men and women of questionable personal ethics. They make it hard for the good ones to make a living and preserve their reputations.

I learned how to do my own title searches and deed work and have bought and sold several houses without an attorney since my experience with that scumbag. I have also had dealings with a couple of good ones since. My closest friend in Lubbock has been a state district judge for 30 years and was a county court at law judge and municipal judge before that. I don't hate all attorneys, just most of them.

I bear you no ill will. My guess is you are one of the good ones.

before everyone gets mad, pull an oil sample and send it out, make sure dirt entry is what caused the damage, if it wasnt dirt entry, then you haave a case...
 
CAPN Harley... . If the Fram air filter is in the stock airbox and was properly sealed then Fram(Allied Signal) is who needs to be contacted. If it was installed by a quickie-lube place, they should ALSO be contacted and get the info on their sales rep. (the guy who supplies them with their filters,oil, etc)

If it was purchased over-the counter and the vehicle owner installed it and allowed dirt in due to improper installation, the owner needs to do nothing except get out his check book!.
