What would have been so much better would have been for you to call 911 and act freaking scytzo scared about a laser pointer being aimed on you, and hearing bullet ricochets, just stay on the phone freaking scared for your life untill the police showed up.

Well here's food for thought.

A BB gun or Pellet gun are indeed FIREARMS. The wonderful little "airsoft" guns are also considered Firearms.

In the state of Minnesota, a BOW AND ARROW are considered Firearms.

"A "firearm" means a gun, pistol, rifle, air rifle or air gun, b-b gun, arrow, crossbow, or any other instrument of any kind, character or description which throws or projects a bullet or missile or substance by means of elastic force, air, or explosive substance likely to cause bodily harm. "

The last part "Likely to cause bodily harm" is where the sticking point is. Can an Airsoft break the skin? Yup. So can a BB gun or Pellet gun.

The biggist problem as I see it is this. The child was not taught respect. Regardless of the firearm situation. The Respect your Elders that USED to be taught, is no longer. Then again... . Common Sense isn't so common either.

The problem here is, you have good sense, morals and manners. Unfortunately the young man and his father, Do not share that luxury!
I would have expected to be handed the rifle or at least witness it and the laser being destroyed with the child watching.
Yeah the steady bead of illumination to me would indicate something more than a toy. And an opportunity for strong parenting!

I'll add my tuppence. Report it to the police chief; tell him you will file a complaint.

Perhaps a 6YO cannot be criminalized and perhaps the father should get a bit of respectful slack. But they can definitely be walked through the system (arresting, lockup, hospital, et al) and ejumicated. The child should be 'scared straight' and the father should be, mmm, sternly rebuked for his leniency. And once they demonstrate that they understand the potential consequences, you drop the complaint. No harm, no foul, and you'll've done your part to ensure it stays that way. And the Chief should be willing to assist, just as he should be ready to rebuke the lenient officer for being too lenient.

Such ejumication should only be as harsh as is needed, and no more. Cool heads must prevail, but lessons also need to be learned.
 
Questions to answer

Did you actually see the rifle/laser? Nope--and that is part of the problem. I believe that when your eye has been exposed to injury that you should know exactly what the laser is and its power rating. '' no where did I see your were shot at'' --I was right next to the building that these rounds were hitting. Because I was operating a nail gun at the time,I thought that something was spitting out of the gun [wire collated nails] By the time I figured out that I was in the line of fire,they did not shoot any more rounds. It was then I got hit by the laser. The building the rounds were hitting was 10 feet away to my side. On the buddy buddy issue,I was stating that because the subject child's father was known to the fireman that lives next door, and I thought that he may have been a fireman. I also know by experience that a city employee in this particular town will be treated with a lot more consideration than an absentee landlord--trust me on this. Untill I investigate this further,I will drop this issue[I guess that I was trying to figure out what motivated the cops, but now,I guess it was police stupidity] ''don't go around carrying a gun'' If I want to carry,I must carry exposed until I get my CWP. That does not mean flaunting a firearm everywhere I go,but there is one handy and discreet at this jobsite. I will use it only as a last resort ,after retreating to the furthest point away from any threat, and the threat is just the neighborhood in general--not six year old boys.

I have obtained a form to register a complaint against the officers involved. Here are my thoughts so far. The officers should have confiscated both the firearm and the laser to be held for evidence. The subject child and his father should not have been sent to apologize to daveshoe without an officer being present to witness/ maintain the peace at the apology. The officer present should have informed daveshoe with the subject 's father present that should he experience any pain or related injuries that the GPD would be available to assist daveshoe's attorney with access to the laser should it be needed in a civil trial. The officers present should have asked daveshoe that if he needed medical assistance, or could not drive home they would assist him as needed.

The officers present should have taken statements from daveshoe and the subject father. The officers present should have searched for evidence for collateral damage to surrounding veheciles or buildings. The fact that daveshoe was subjected first to the dangers he faced and the resulting stress ,only to be confronted by an angry father [without the presence of a peace officer] is inexcusable. This could have easily created a secondary incident. Discharge of a firearm in the city limits is a crime. The father needs to be cited to court for this and the proper fine imposed at the discretion of the muni judge

A few actions like this like this by the cops would have created a pucker factor in the father as he contemplated his responsibilities. Instead the father just goes around as a big sphincter with a giant hole in the middle. What are your thoughts?
