Let me add one more thing that gets me upset. I restore antique farm machinery and take it around to a number of shows over the summer, this is when I first started looking into all this. I only haul my own equipment, or locally some friends (all at no charge). Therefore I felt I was not hauling commerce. According to Ohio and Penn. this is NOT the case. Because this is working with 'antiques' the shows I go to are considered exhibitions and therefor I 'could' sell them at a profit or buy other stuff at the shows. This means that I COULD make money at this hobby. Both states have told me that this ability to buy and sell stuff at the shows makes this require all the commercial stuff. I am trying to find something in the DOT regulations that will go against what they have told me but I haven’t yet. So at this point I am going through all the hassles of getting the following; DOT #, Med. card, Operating authority, etc. Trust me there are a lot of confusing forms and when you try to get help one person tells you that you don’t need them and the next person says you do and one way to fill it out, and the next person tells you to fill it out differently.

sewman: You are close on the State Vs. Fed. laws but not quite. If you haul ONLY with in your home state then you can follow state laws. But, even if you only on rare occasion, go out of state then the Fed. laws are applicalbe EVEN while in your home state. Also note the states do not have to use the federal laws as written. They can add to them or make them applicalbe to a wider range of vehicals.



To all: It is written in plain text (the only thing I have found so far that is) that if a state makes the laws more inclusive or more restrictive, OUT OF SATE haulers only need to follow the FEDERAL requirements. This is regarless of commercial or not. So if you are in another state and they try to place there laws on you you can fight it. This is only where their state laws are different than federal ones.

I was only stating what the Dot man told me when Ihe pulled me over. He said I only need to put the Dot# on when I go out of state & that if I wanted to I should get a magnetic sign because I only need them: the DOT#,logbook & Med Card when I go out of state not in state.

So Mike what kinds of tractors do you have?

sewman: Well again we have been told diffeing information from DOT, but oh well.



As far as my tractors I have a John Deere 'R' (BIG), a tiger (small), I also have some Hit-and-Miss engines, (Jager, Domestic side shaft, IHC 'LB'), plus other misc. small stuff.



I am currently looking at another 'R' in TX. problem is finding a way to get it here with out paying more than its worth in shipping.

One other question: I have farm trailer plates on my trailer. I keep my equipment in Dallas. I don't have a place to keep it when in Ark.

1. Does farm plates change anything in regards to the medical requirement?

2. If I am hauling my loader to the farm, my actual gross wt. of the trailer loaded is under 10k pounds, even though it is licensed for 16k. Do the DOT rules for medical, etc, only apply if the actual wt. is over 10k or if it is registered to carry more than 10k?
 
The rules go by registered weight. Not manufacturer weight or actual weight.



As for the farm stuff... The Fed. rules allow the States to read/write a lot into the allowable farm exclusions. Because of that you may need the Med. card and stuff or you may not. (State specific. ) Also, my understanding is that the max. distance farm plates are good for is 150 miles from primary farm, anything beond this and the eclusions no long apply. (Personaly I think most officers cut you some slack with farm plates unless the load is very questionable or you are a long way from the farm. )

B'Gate, Do you have a farm specific insurance policy? The policy I have is to vague even though it is supposed to cover what I do. I call the agent and they say "yes it's covered" but nothing in black and white. So, I found a company specifically for farms and have been in the process of changing. Now, I realize that we are in different states but thought I would run this by you anyway.



The agent told me that even though my 14k trailer was registered at 10k, due to the "shear" scope of it, it would not be covered. My auto agent always said it did not matter and like you, I had informed them of it's size. So, here you have two agents telling you different things. I will tell you that my auto policy would not cover the trailer for theft, etc. , only liability.



The farm policy however, would cover anything I wanted on the trailer for a very reasonable price.



Another biggie here is for my Ram by the way. I forget now but I think my Ram is maybe 800 a year to insure. Through the farm policy, it would be 278 a year! They won't cover my wife's Explorer or car though.



Mike, A gear head buddy told me this about race cars/trailers. He said for example, you get stopped coming/going to the strip. Trooper says, "so, how'ed yo'all do today?" You know, real friendly like. So, your guard down, say, "I did real good, won some bucks and a big trophy". Bingo! On the other hand, you knowing whats up say, "I didn't do nothing". See ya!

I picked up PA publication 194 (6-01), Pennsylvania Department of Transportation, Trucker's Handbook at the farm show and just tonight opened it.



Like the trooper told me, a truck towing a trailer registered in excess of 10k must be registered in combination. That would include both empty weights and total load weight.



Drivers of commercial vehicles over 10k in interstate commerce or 17k intrastate commerce must also possess a valid medical examiners certificate.



And lots, lots more. First time I came across this info.

Towing an RV you are exempt from DOT/COMMERCIAL laws.

You could have a 50,000lb FW/camper behind a big toter, as long as it is a Recreational Vehicle they cant do crap.

And... you don't have to have a clue when it comes to being able to handle all that weight. Go figure.
 
yep, Its in the fed. motor vehical saety book. RV's are excluded from the restrictions.



So, I wonder, if I strap a sleeping bag to my trailer and called it a open RV, could I get away with anything. :D



also, yes in PA if a trailer is over 10K (not a RV) and in interstate travel then the truck pulling it needs to be registered at the combined allowable rate. In addition the trailer needs to be registered seperatly. One thing is if the trailer is over 10K then you can get a permanet registration. (yearly registration $27. 00 permanent $135. 00)

I think the midwest states are the pickiest concerning DOT regs. In Iowa, there have been checkpoints with inspectors that stop all hauling vehicles w/wo trailers for complete inspections, of mechanicals and paperwork. Needless to say, there were LOTS of fines issued.



I believe as state budgets get tighter, that the state looks for more money from fines to pay for the road construction. More tickets, more dough.
 
I still have not seen a good definition of "registering in combination", trailer and truck. What does this mean. From what I can find out in Texas, everything is registered individually. When I registered my trailer at 16k, there was nothing about "combination", no restrictions, no other questions, and it obviously is not an RV. It is a flat bed with a dove tail. If it makes a difference, Texas does not title trailers either. I have been told by others that it may be possible to obtain a title, but I have never heard how to do so. I just give them the manufacture's name and serial number, as I recall, and registration is issued. For what it is worth, Texas does not even require notarized signatures on car and truck titles.



Again, I researched this topic I think rather thoroughly (sp?) and was told by the Texas DPS exactly what the rules were.
 
This is how it works in PA

I think I finally understand it for my state anyway. If you follow this link to PA's fee schedule. To register a combination, you would take the gross you want. In my case, in state, no CDL, <26k. Follow the fee for class 8, $405 per year. Then, go down to trailers. for >10k, $27/year or $135 pemanent. Course, I would still need a medical card and twice yearly inspection on the trailer. For commercial, DOT number, insurance. blah, blah. Less hassle (to a point) and cheaper is to go farm registration. Not something everyone can do. I can because I have my farm registered and now set up as an LLC. Restricts your miles in some cases and you need to watch what you do. Ain't it great!

Farm Plate GVW in Minnesota

Lat me tell you this is the best discussion I've seen on this board.



Well I have a question.



I currently have a 25' Felling gooseneck registered as a Farm Trailer for #25000. Trailer is rated at #18000 on the deck. Trailer weight is 6400# empty



My truck is licensed as a personal vehicle. Truck is 6700# empty.



I haul between 16200# - 17400# on th deck. Since I use the beaver tail of the trailer, I balance my load. Example of empty and full loads are (truck scales are good for measuring this):



Steer Axle Drive Axle Trailer Axle Gross Weight



Empty 4340 3580 5640 13560

Loaded 4400 5040 20160 29600



Anyway now my question... Since I only haul hay from farm to a buyer and I am over the 26,000, do I need a CDL?

Well, it would be my understanding that as long as you are hauling your own products or things you use with your own trailer with your farm plate, you are ok. You might want to ask around and see if there is a mileage limit on travel or a state line limit. I would not know about the GVW ratings, other than the GVW ratings go out the window with farming or ranching.
 
Actually this (farm tags) is one area of the laws where the States have a lot of control. Most times you can not go actoss state lines with farm tags. If you have farm tags and go beyond the state milage limit or across state lines you now have to meet more requirements.



This being said the reality seems to be that most officers know there are exclusions for farm plates, but don't know more than that. Therefor they will let you get away with a lot because they don't want to go tourgh a hassle and then find out that what they though you couldn't do you actually can.



The main thing I have found is don't do somthing that will draw extencive attention to yoursenf and be polite when they stop you.

that's too much weight, even for a "farm vehicle" first of all, you are hauling hay for your brother, sister, cousin's farm , not for sale. get it? second, you could be stopped and weighed, fifty yards outside of you driveway, with that kind of load, and written up , regardless of what state . the dot's main responsibility is to cite overweight vehicles. and you classify there. if you go across state lines, the 150 mile rule holds true , meaning no logbook, etc. but you are still overweight, regardless of what your business or intent is. these rv's and farm vehicles are getting ready to be rudely awakened to the fact that you can't hide behind being a private vehicle, when you exceed 26001 lbs. gross comb. as a farmer and a businessman , operating in different states for 16 years, trust me. the law has always stated that farmers and rec veh are exempt from the fed regs. well, like all good things, people have abused these rights, and things are getting ready to change. this is a "heads up" from someone that has been there, done that. :eek:

In PA, a farm vehicle hauling commodities "for sale" to others is perfectly legal. You need not play the "race car/trophy/cash" game. There are two ways to approach licensing. You can plate as a farm vehicle at a reduced fee. I believe this is where the 150 mile limit falls in. Or go with a certificate of exemption. There are three exemption classes, depending on weight, hours of operation and inspection requirements. Max distance with these is very minimal.



As Packman spoke, this is being scrutinized. Especially the exemption stickers. With them, you need to be careful even doing your neighbor a "favor".



Today, I read a newspaper article concerning truck crashes. Mark Schweiker (our governor since Tom Ridge went to the White House) wants something done. One thing he suggested was reducing the amount of weight from 17,001 pounds to 10,001 pounds that it takes to be considered a heavy truck, and thus subject to random inspections. It will be interesting to see how we dually owners respond to this one. I can just see the DOT man crawling around my horse trailer with a couple of my "girls" kicking the wall down inside. Ha!

Gov. Mark Schweiker sounded like a guy who had just been tailgated by a tractor-trailer rig.



He employed that tone yesterday in outlining a half-dozen highway safety initiatives during the Pennsylvania Truck Safety Symposium at the Clarion Hotel & Convention Center in Middlesex Twp.



The ideas, which participants in the two-day symposium will ponder, ranged from toughening Pennsylvania's tailgating laws to making more trucks subject to roadside safety checks.



"I've been on the road for almost 10 to 12 years and, bluntly speaking, I don't like a lot of what I see out there," Schweiker told the crowd of more than 200. "And it has to be confronted. "



That three state troopers and six Pennsylvania Department of Transportation workers have been killed in highway incidents during his time as lieutenant governor and governor emphasizes that need, he said.



He noted, too, that 859 people died in accidents involving trucks in the state between 1994 and 1998, while 100 people were killed in accidents in highway construction zones between 1996 and 2000.



Schweiker said there must be initiatives aimed at aggressive drivers and a push to improve education for drivers of automobiles and heavy trucks.



"There are a percentage of drivers out there who are way too careless," he said. "That's where the spotlight has to shine. "



There should be a review of how penalty points are assigned to drivers for violations in construction zones, plus efforts to heighten driver awareness of construction zone safety, he said.



To emphasize that point, he ticked off the names of five Beaver County workers who died when an 18,000-pound truck lost its brakes in a construction zone.



"It cannot stand, friends," Schweiker said. "It cannot stand. "



Truck drivers should have to take knowledge tests before receiving Class A or B licenses, he said, and there should be more frequent random safety inspections of heavy trucks.



Schweiker proposed that such inspections be extended to trucks that weigh as little as 10,000 pounds, down from the current 17,000-pound guideline.



Symposium participants will review the initiatives and make recommendations to PennDOT's Commercial Driver and Vehicle Task Force. The task force will then report to the legislative budget and finance committee by July.



Delegates at the symposium included representatives from state and federal transportation agencies, the Insurance Institute for Highway Safety, Citizens for Reliable and Safe Highways and the trucking industry.



In tandem with Schweiker's initiatives, Glen R. Thomas, chairman of the Public Utility Commission, released a statement committing the PUC to more truck inspections on roads where accident rates are high, promoting truck-driver education and auditing trucking firms with "unacceptable" performance records.



Schweiker, who preceded his speech with a walk around a tractor-trailer rig brought in for the occasion by Kinard Inc. of York, said he is not blaming truckers for all the state's highway hazards.



That onus falls on every driver, no matter the type of vehicle, who pays too little attention to the road or is in too much of a hurry, he said.



"There are culprits out there that just don't get it. They're dangerous," Schweiker said. "
