In case you're one of the last people on the planet...

I've been screwed on an ebay auction for $3450. 00 where the guy is refusing to ship the stuff i paid for.



he has made excuses as to why he hasnt shipped them and now is flat out daring me to find him and good luck getting my stuff out of him.



I've reported it to eBay

I've reported it to Paypal

Ive reported it to my credit card issuer

I've reported it to the FBI's internet fraud team (IC3)



on monday i plan to call paypal and my CC company and speak to them live.



what else can i do?



he's is hiding behind the statement "you sent payment on your own free will and there is nothing any law enforcement can do about it"



he says he's gotten away with this before and all he has t odo is break ties with ebay and paypal and cancel his CC acount asociated.



isnt this fraud, its $3450. 00 not just chump change and wont law enforcement get active in it? who can I report this to in the legal arena?



The guy's ebay account was spotless. 250+ sales 99. 6% positive no negative feedback recently or anything to indicate he was going to screw me!
 
ebay will give you his name and address. I have done it in the past. They provide him with yours and notify both of you that this has been done.

if you charged it on a normal credit card and not an atm type visa or mc, you can dispute the charge and the card co will withdraw the charge
 
Yes I charged on a regular card that I use only for the internet. I've turned it in via their but plan to follow up with a call in the morning.

Back on track here gang. My kidding around got the mods (Andi) involved but we have it straightened out. Thanks, Andi.



An update on the matter is: I found my state (IL) has a newly formed Internet Fraud Unit. I called them and they took all my info including the guys name and contact info I had. Then in coordination with the East Greenbush PD tracked him down and the paid him a visit. They couldnt tell me alot but did say they were out a few weeks ago over a similar matter on some car seats.



long story short I have a UPS tracking number in hand. Its due to my house on the 29th. I have arranged to video the delivery and opening of the boxes with the UPS driver to witness it just in case he "rock in a box'd" me or sabotaged the parts.



what an ordeal.



If dealing with ebay I have found thru the help of the user community groups that inflamatory remarks left in a user's feedback is grounds to have the feedback disputed and removed where it is never to be seen again. The advice I was given was to leave negative feedback like this: Paid "date" item not recvd until "date" Buyers Beware!



doing it in this manor will leave him no recourse to have it removed and it will stick.



secondly, the feedback system of ebay is flawed. Use www.toolhaus.org and ALWAYS do a search for negative/neutral feedback on a user you are considering buying from. If i had known about this site and done it first I would have been able to view seven reports of the very same problems others have had with this guy PRIOR to buying. One even mentioned having to get the law envolved too!



I'm very upset with ebay and paypal's lack of bite when it comes to avoiding and resolving issues like this. the guy is a habitual offender but looks squeaky clean by knowing how to work the system. Beware or cjmagnano!
 
Yes, I got my state's internet fraud team on it and the East Greenbush NY police showed up at his home and kindly asked him to ship the stuff.



I got everything here and it all checks out OK. I have since sold the turbo off the kit due to it being too small for my engine.



The guy is a total scumbag. He tried to turn the negative feedback I left him into looking like I did something wrong to him.



He took my money and got sand in his panties when I got firm with him to ship my $3450 item after three weeks of his excuses and tried to hold it hostage on me by daring me to find him.



I can be anywhere and work from anywhere, I was ready to set up shop in his back yard if I had to. But it all worked out LEGALLY. :D

Kind of off topic, but i have been dissapointed with the current trends in feedback. Back in the day, i would get positive feedback left as soon as i pay. i alway pay within hours of getting a total from the seller. Now it seems all the sellers wait to leave me feedback until i leave them feedback. The way i see it once i pay, i have fulfilled my duty as a good buyer. Now it seems the sellers are withholding your feedback as a discouragment to leave them negative feedback if there is a problem. It definitely seems as though you can not trust the feedback anymore. Here's a good way to leave bad feedback on ebay and minimize retaliating feedback. That system is set-up for 90 days, that's how long you have to leave feedback. Wait for 89 days, maybe even to the last hour and then hammer them with the truth. Chances are very good they will not even get to reply.



I would think if that was a transaction from a state other then yours he could get it for fed fraud offense but I'm no lawyer...
 
I just hada deal like Rubberneck said. I bought a FSM on there, paid right away. When the manual came, it had a label "Please leave us good feedback, and we'll do the same" or something similar. I was so pissy about it I almost sent them a nasty e-mail. I figured I wouldn't win on that one with my 100% rating, (12 items) so I let it be. Too many shysters and scumbags out there now! #@$%!
 
I last night reported a scam to Ebay where these scumbags copy old,sold listings of generators and re-post them later. This ***hole in Virginia was trying to sell a diesel Deutz 15k genset that was listed and SOLD about a month earlier in Calif high desert area LANCASTER, Ca. I told ebay to look at the pictures... I said "They don't have Joshuah trees in virginia" Thety put them up for only 24hrs and low start price with no reserve. This guy had about 30 copied generator listings all the same way.
