The whole rifle to the head thing is what gets me. I even think people here in CA would've given him the needle. Interesting case, nonetheless.



Oh yeah, he escapes, and they still knock 8 years off for good behavior?
 
I was wondering how he managed to get the time knocked off too. He said the bullets to the head were "to ease the suffering". From personal experience, I know that's what a lot of people do to animals they've trapped. Of course, the game wardens weren't animals though. He did leave the only eyewitness alive though. That says something for him.
 
OK, Here goes nothing!

I do not have a flame suit on, nor do I have a wish to receive hate mail about this deal. The trial was held about 8 miles from where I live. As I recall, the jurors were pretty convinced he felt threatened by the actions of Pogue(sp). The ONLY reason he was convicted was because of the head shots. The concensus was that the head shot was not a reaction, but a decision to terminate them. That being said(recalled?), on to the escape issue. I may be loosely quoting, but Idaho law states that if a prisoner, convicted or otherwise, feels imminent threat to their life/safety, they may flee custody. I believe this is from the old days of vigilante justice. I am not sure if this law is still on the books, due to it being used by Dallas as his defense. He is still a heated subject around here, pro or con. I was always intrigued by the case and have met 2 of the more central figures. Sheriff of Owyhee county, Tim Nettleton considers Dallas a murderer in the most vile fashion. He is a man of impeccable character. I lived in the Twin Falls, Idaho area a few years later and met the witness to the shootings. He in no way resembled the timid,trembling,spineless character of the tv movie. He did not care to elaborate on the events. The person who introduced us did relate what he had been told. The witness told him there were threats made, and a gunfight ensued. I think a point was reached where there was no turning back. It is sad that two men lost there lives, and a third lost most of his, over a ticket. It should have been settled/fought in court. Things were done, looking back,that were foolish. My opinion on the case is that Pogue said or did something that Dallas saw as a threat, and the initial shots were fired. When he realized what he had done, Dallas finished the job. But after years of heated arguments, I do not care to continue them. He was convicted and did the time. DK.

You have been following this if yoiu know his name! He told the guy I know he was a little shaky after the shootings. Thought he might be next. I only met him once, and he was a customer of our business, I thought it better not to press the issue. He didn`t brag about being there,just told the truth in court & let it go at that. He seemed uneasy to discuss it further than to admit he had been a little scared at the time. DK.
 
Found what I could on the killings. My opinion is once the game wardens were shot and no longer a threat it should have stopped there. The fact that he executed the two game wardens with the 22 is what bothers me. He should have got life with no chance for parole, I would be really interested in hearing how anyone could explain a reason for that, and how it could be justified.

I agree with you about the head shots. He should have stopped there. I have wondered about this for 20+ years. I believe the jurors felt that since Pogue threatened him by reaching for a sidearm, his response was justified as far as the initial shots. In this part of the world, people are a little different from the larger metro areas. Gun control, politics, etc, it`s just not the same train of thought. There are a lot of people here who wanted no time for him at all. It is a polarizing issue, or it was. DK.
 
Cluade justified the shots to the head as "to ease their suffering". He was a trapper, and that's what trappers do when they catch an animal, put a mercy bullet behind the ear. Yeah, the game wardens aren't animals, but that could have been his natural reaction, or just a habit. But, yeah, those shots shocked me too. The head juror said that had it not been for the head shots, that he would have walked.
 
I'm sure Claude has some internal misery and suffering. Maybe a head shot from a . 222 would help relieve some of his misery and suffering.
 
Try reading "give a boy a gun". From my knowledge of the events which is fairly extensive I think the book gives a fairly accurate portrayal of the events.
 
If you kill someone, you should die. Period... . There is no reason for him to get out. However, I'm sure I would agree with him on some of his opinions how our government is wrong
