How can I turn the Engine over without it starting?

I took what RMalone wrote to mean making it illegal, not a lawsuit. But what if someone was using the smarty on private property and it malfunctioned by hanging the throtte and it caused an accident. If it is causing the throttle to hang it should be fixed, and I'm sure every attempt will be made to fix it ASAP. Those guys seem to react very quickly to problems and requests for changes.

Any box that modifies the stock ECM program is already illegal on public roads. Another law wouldn't make it any more illegal.



Actually, it is only illegal if you get caught. :-laf That's why I always run the stock program until I get off road. ;)

All software tampering is illegal. That does not mean that they are enforcing it, but if you, let's say, got a new person in charge of the EPA, they could shut down all these companies overnight. Only products that carry an EPA or CARB approval are legal, which is a very expensive process, similar to what Cummins would have to go thru to certify a new engine. As far as safety concerns (which this issue is) the DOT enforces that, not the EPA. By the way, look at all cheap fog/driving lights, and they all say "off road use only". They must be DOT approved. Same for mufflers, and even Donaldson classifies their aftermarket mufflers as off road use only, unless you replace it with the identical model that came on your truck (this is for EPA noise regulations)



It is easier to certify emissions neutral products, like air filters, mufflers, underdrive pulleys. Anything that has the potential to change emissions at all, is illegal until they are EPA and CARB certified. That's 99% of what's out there.



But what if someone was using the smarty on private property and it malfunctioned by hanging the throtte and it caused an accident.

Then the owner of the racetrack, or farm, would be liable. That's why racetracks have rules about roll cages, exhaust bolts to catch flying turbo wheels, etc.



I am not saying they are not trying to fix this, but don't assume that anything that is sold is legal. Possession of a (smarty/bullydog/tst/whatever) is not enforced like possession of drugs, but that does not mean it is legal.

I have once run across a very scary EPA standard letter on the web, that they will send to a company that they suspect has been selling illegal products, and one of the questions is something like "what have you done to ensure that your products labeled off road use only, are actually only used offroad?" The fines are so steep, thousands per such product sold, that they (manufacturers/distributors) would all run away immediately.

Diesels do not have butterflies to control air flow. If you get on the pedal hard it dumps the fuel in. More fuel=more air intake=more boost. The engine wil not idle down until the fuel is gone. These are not gas engines. If you were to put transmission in nuetral and revs never came down then your throttle may be sticking.

Hanging Throttle

I too have had this problem on the Wild settings shifting from second to third on my 6 speed NV 5600. How ever before I had the Smarty I had a Quad race box, and before that I had a Bully Dog Power Pup. They also did the same thing on the high settings. I don't think the Smarty is a stand alone culprit of this problem. Oo.
 
I have the TST and this happened to me. Dropped the family off at the front door at church. I stabbed the go pedal pretty hard and then let off but it was still fueling. A couple of seconds and the throttle did let off. Good thing we were one of the first families at church with very few vehicles in the parking lot. The setting on the TST was 4 on HP and 0 on Torque. Repsonse for the day was no more hot rodding in the church parking lot. :eek:
 
Guys when the Smarty "hangs" its more like 8-12sec before it stops fueling on it's own. NO WAY it is caused by latent boost or fuel pressures.



If the government decides to crack down on illegal boxes they aren't going to worry too much about the end user they will go after the manufacturers and just shut 'em down. No supply = No usuage.
 
Hanging throttle....

I have the "Wild" version that came with my smarty. Today I downloaded SW #9 to see what it had. My truck took off like a bullet but the thing that scared me was when I took my foot off the accelerator my truck keep going. I applied the brake and it wouldn't stop. I had to put into neutral to actually slow down, then my brakes worked. Has anyone else experienced this? Why would it do it?



I've run the smarty on many other settings and this didn't happen. This doesn't make me want to try #9 again. Any help would be appreciated.

P. S. My TST box was off during that run.





I had this problem with my Diablo downloader,... ... occassionally. It does get your attention for sure.
