Glad to hear you guys are fine! Sounds like he could not handel what he was driving. Some people just have no idea the amount of damage they could inflict on someone and they drive like they don't care what happens.
 
I know someone that really was run off the road (and hit a pole) by another driver. According to the law, The fact he swerved to miss the other driver (and hit the pole) means it was his fault. If he had hit the car that ran him off the road (because it was in his lane) it would have been the other guys fault. This was in PA also.
 
I've had that experience before. I used to own a 01 Ferd F250 4x4 gas powered 5. 4L with the ford tow mirrors. I was driving on a back road headed home around 7 pm in July of 05. I had the window down and my shirt off cause I had just left my buddies house and we all were swimmin. A guy in a ford excursion with the same tow mirrors came flying over a hill in my lane and I went over as far as I could without sideswiping a large oaks ree. Well his mirror hit mine dead on, glass blew up all over me inside the truck and cut me from head to waste. I looked back and the excursion driver has sh*ttin and gittin away as fast as he could down the road. I had to get 13 stitchs and a 1/2 inch piece was pulled outta my neck right next to my adams apple. Luckily I was right next my house where it happened, so i pull in and my father takes me to the hospital, as my mom stayed home and called the police. The officer comes to the hospital and starts to chew me out about leaving the scene of an accident and threatins charges for it. He to said if I had swerved and hit the tree it would have been my fault. Nothing ever came of the report and the other driver never reported the accident. Crappy day and I was out 280 bucks for a new mirror.

Same in Tx.



The law I love the most in texas is the "failure to control speed" dealing with being "rear-ended". Automatic guilty until proven innocent.



Do not swerve for anything in the road. It is better to head-on, and kill people than to hit a tree, or go off the road. Atleast that's what the law says. . :confused:

P. S. I do not agree with the law in that case, but, short of a head on, I'm probably not going to get out of the other guys way if he is in my lane. That's the way the law is written.
 
My definition of a tough decision is who do you hit, the jerk causing the accident or the innocent driver getting hit by me avoiding the jerk?? I've made this decision all ready & just missed hitting the jerk by a coat of paint, keeping my truck on the yellow line & not crossing it & not hitting an innocent driver head-on. The jerk ran, or almost ran a stop sign. If I hit him, I would have t-boned him, hitting him in his drivers side & it would have been his fault. I don't think he'll do that again as the sight of my grill in his face under these circumstances was definetly threatening, along with my 2 "fingers" I gave him! The way I see it you want to cut in front of my truck, fine. You'll pay the price if I can't stop in time. I'm not moving out of my travel lane.

If wanted, the file can be obtained, if I need it. He was still on an active 30 day watch, meaning if they observed him doing something illegal (driving) there would be no warning, instant fine. Anyhow in my certifications was my EVOC, (Emergency Vehicle Operations Certification), with notation for exemplary skills in both low & high speed driving in any conditions. The kid is driving the car again, he spent Friday night pulling in the end of the driveway, turning around & reving the motor, spinning the tires, down into the curves, as I sat there waiting for the thud. He backed out before entry as the roads were wet. I'm almost ashamed to admit I wanted to hear the thud, as the 2nd crash may have put the car out of its misery. :-laf Oh well, if anything more comes up, be sure you'll be notified. I'd almost be tempted to take a couple pictures of him doing this crap at the end of your driveway. Just for proof if you should need it.

They wanted absolutly nothing to do with that. Wheres The Freedom?
