JATO Rocket-Powered Car Story

Back in November I got a ticket for using a center turning lane to drive around a car making a right turn from the driving lane. It was a cop who immediately pulled me over and cited me for doing so.

Fast forward to Friday, when I finally get my day in front of the Judge.

Sparing the all the gory details, the judge asked the officer on the stand,

1) What time was it? (2AM)
2) Were you and the defendant the only two vehicles on the road? (yes)
3) Was the defendant drunk? (no)

During my cross examination (yeah mine, I dont use a lawyer for traffic violations) I asked the officer, "While you had me pulled over, did other vehicles use the turning lane to pass our vehicles?"
"Yes. "

I pressed on, "Was that ok for them to do that?"
"Yes, because they were doing so in the interest of my safety. "

"Would I be within reason using that lane to be sure that while we were operating our vehicles in close proximity that we were also safe from collision?"

At this point, the District attorney spoke up, "Objection Your Honor, defendant is clearly asking the officer to speculate and come to a conclusion without facts. "
I replied, "Your Honor, the defendant just answered the last question using speculative information, I think he can do it again. "
The Judge looked at me, "Thats true, he did," turning to the officer he said, "Overruled, answer the question. "

"Yes, I suppose it is within reason for you to operate in a safe manner. "

I then pressed him on the details of the law.
"Are you familiar with section 3309, where it states I am allowed to use the center lane if I ascertain that it is clear of oncoming traffic?"
"That section does not apply, I did not cite you under that section. "
I replied, "That section specifically refers to the same lane markings and direction of traffic that existed where the alleged violation occurred, does it not?"
"Yes, but it doesn't apply. "
I then slammed the door on him, "I am under the impression that ALL of the vehicle code is in force ALL of the time. So what you are saying is, you as an officer of the law can somehow do away with a section of the code as you see fit, is that correct?"

As he began to sputter, the judge spoke up,"Gentlemen, I've enjoyed both your arguments today," He turned to me and said, "The defendant is not guilty, have a good day. "

A good day indeed, I managed to have two objections by a District Attorney overruled, and got a not guilty verdict without even getting on the stand. In fact, I did not even have to finish my cross examination.

Some days, the good guy wins.

I've been to traffic court here in NJ just a few times. Abortion of justice is the term that comes to mind... .
It's all about them getting your money in their pocket. That's it... plain and simple. Stinks on ice.

Boy, Your local District Attorneys sure must have alot of time on their hands to appear at an infraction hearing. When ever I go to court, I am acting as the Prosecutor and do not get the luxury of having a DA assist me. I must say, that You did a wonderful defense and if I was the Cop, I would not be out doing Traffic enforcement at 2am. I wonder how many of the vehicles that he let go past you as he was writing a citation to you were under the influence. IMHO, 2am is a prime time to go after the drunks.

I have never had any luck fighting the tickets that I felt were wrong. . might as well pay and save the day lost work #ad
 
Here's a similar one that happened to my brother many moons ago. He got pulled over for speeding after stomping on the gas then pulling over to let a tailgater go by. Turns out it was a cop who pulled in behind him, wrote him a ticket and when my brother got some attitude, arrested him and had the car towed, leaving my sister (licensed driver) and another friend to find their way home in rural Maine in the middle of the night.

Court day comes up and their case doesn't get called until the very end of the day. He had a lawyer with him - the one handling my dad's estate at the time - and my other brother there, too. Did I mention that my brothers are twins? Identical twins? Anyway, they finally get called and the lawyer puts the cop on the stand and asks can you identify the person you arrested on the night of XXX? The cop looks over at the table where my brothers are sitting side by side, one in a blue suit and one in brown, points and says, "Yes, it's THAT one. " (Pointing at one of my brothers). After a short pause, "No, THAT one," pointing at the other one. The judge thinks for about a nanosecond and says "Case dismissed. "

Ranger, your comment on drunks is exactly what a couple of friends (who are on the same force as this guy) said. The biggest laugh they had was the fact that this guy was probably looking for a drunk, and as well as they know me, they knew very well he was looking in the wrong place. I don't (as a general rule) drink. As you might expect, I hear they had a bit of fun at his expense over this one.
 
I was going 70 in a 55 when I got pulled over, showed the cop my oversized tires and said that must be the reason. He was understanding and wrote the ticket for 65. I went to court and told the judge the same thing, she was also understanding and dismissed the ticket saying everyone drives 60 on that stretch of highway. Only problem was that I was in court much longer than anticipated, came back to a parking ticket on my truck that was more than the speeding ticket. Guess it doesn't pay to lie, my speedo is calibrated for the larger tires, I knew exactly how fast I was going.

FYI... If any of Y'all get a M. V. summons for speeding, it's probably worth a trip to court and at least a short chat with the prosecutor. Here in Vernon, and I'm sure many other towns, it's common practice to downgrade to the next lower violation, i. e. , a violation for 50 MPH in a 35 MPH is 15 over, it gets downgraded to 49 MPH in a 35. The driver walks away with a smaller fine and less D. L. points and the court is happy because the calender is moving along. I've seen speeding summons take over 2 hrs. in trial, especially if the driver has an attorney.

Max340, good for you. Sounds like a B. S. summons to issue anyhow, unless you had a major attitude, which I doubt. When we run DWI patrols, we stop people for ANY violation. Note that I said STOP. If the driver of the car is not a DWI, I send him/her on their way with a verbal warning, nothing more. Sounds like you were stopped by either A) an inexperienced Officer or B) a ticket writer that was trying to up his numbers so that he looks good to his superiors. They like to see big numbers, they think it's an indication of Officer productivity #ad

BigSaint, I agree with the officer productivity thing. That same officer was recently commended in the newspaper for breaking up a car burglary ring.

Any guess whose truck the perpetrators crossed in front of at 3AM on a bunch of BMX bikes, chased down a few alleyways (I can only imagine the thoughts in their minds when they heard and saw the huge black truck and the noise of the Cummins coming down the alley like a small locomotive) and then had their whereabouts info taken back to (yeah, you guessed it) the very same officer who three months later cited him for a left lane violation?

Some days ya just sit back and say, "ok, how'd that work?"

Its a small town, so I am sure I'll cross paths with him again.

Down here in the Lone Star State if I pull someone over at 2am, I'll usually cut him/her some slack as long as they are sober and not driving too crazy(we have the worst drivers here). . If I pull over a cummins however, I compliment the truck and send them on their way!!!!! #ad

Nope, dead wrong. Music to my ears. Heck, I used to follow them around with the windows down, just so I could hear the mighty Cummins, while at work. #ad


Now, the riceburners with those 100 HP exhaust tips and the thump, thump, thump music, that's a different story. I guess you could call it "profiling" in a way, but it's a good way in my book.

A police officer pulls a guy over for speeding and has the following
exchange: Officer: May I see your driver's license? Driver: I
don't have one. I had it suspended when I got my 5th DUI. Officer:
May I see the owner's card for this vehicle? Driver: It's not my
car. I stole it. Officer: The car is stolen? Driver: That's
right. But come to think of it, I think I saw the owner's card in the
glove box when I was putting my gun in there. Officer: There's a
gun in the glove box? Driver: Yes sir. That's where I put it after I
shot and killed the woman who owns this car and stuffed her in the
trunk. Officer: There's a BODY in the TRUNK?!?!? Driver: Yes,
sir. Hearing this, the officer immediately called his captain. The
car was quickly surrounded by police, and the captain approached the
driver to handle the tense situation: Captain: Sir, can I see your
license? Driver: Sure. Here it is. It was valid. Captain:
Who's car is this? Driver: It's mine, officer. Here's the owner'
card. The driver owned the car. Captain: Could you slowly open
your glove box so I can see if there's a gun in it? Driver: Yes,
sir, but there's no gun in it. Sure enough, there was nothing in the
glove box. Captain: Would you mind opening your trunk? I was told
you said there's a body in it. Driver: No problem. Trunk is
opened; no body. Captain: I don't understand it. The officer who
stopped you said you told him you didn't have a license, stole the
car, had a gun in the glovebox, and that there was a dead body in the
trunk. Driver: Yeah, I'll bet the lying s. o. b. told you I was
speeding, too

I must admit that the TRUTH seems to work the best. When asked if I know why I'm being pulled over I respond yes, I'm in a hurry to get somewhere, no exucuses you got me(last time to E-town dragstrip!). I had a CT state trooper say to me "you saved yourself $300. 00, most of these a**holes out here would have lied to me"
