Would be thief got what he had coming. Maybe he will think twice before trying to steal a car next time. He gets no sympathy from me.
 
I didn't read the link, but in Texas deadly force can be used to protect life or property. A carryover from our 19th century heritage of dealing with cattle rustling and horse thieving.

That's a good idea for the country. Even in the "Wild West" of Nevada, they have to be in your house or you have to feel an imminent threat to yourself or others. Unfortunately, your CTD isn't included in "others". :rolleyes:
 
With the cattle rustling we have going on here in Southwest Missouri that law would be a god send to put an end to it fast. He gets a thumbs up from me.
 
Good thing that didn't happen here in mASSachusetts... the thief would have a line of ambulance-chasing lawyers waiting to sue the shooter, and would most likely win!! That's sad. Glad it happened in Texas.
 
I'm sure most of you have heard of Florida's new law concerning weapons. It is pretty close to what they have in Texas and I would have no problem shooting to protect.

My buddy's caught a thief that broke into their truck's when we all rented a house about 7 year's ago. My buddy was chasing the guy with a shovel and while they were running, the guy turned around to see where my buddy was and the stupid thief ran face first into a tree! :-laf :-laf That was worth it alone! ;) He got away somehow but they found another guy hiding in the backyard! That was their 2nd attempt to get more after a first succesful attempt of getting CD's and a stereo. The cop's were called and as far as we know, they did'nt even do anything about it! B. S. ! :-{} My truck was never touched, but I got up everynight with my pellet gun to check thing's out! I guess the pellet gun would'nt of had quite the effect of a . 45! :-laf I'm glad that guy plugged him! Although I think I read that the thief might have been dead! If so, now what happen's. What is Texas law with that situation?
 
If it was a legitimate shoot (i. e. , in defense of life or property), the DA will send the case to a grand jury with his/her finding of justifiable homicide, the grand jury will no bill the shooter (so that the case can never be brought to criminal court again), and that will be the end of the criminal process.



Unfortunately, under civil law, one can just about sue anyone for anything, so the thief's family could theoretically sue the shooter for damages, but any Texas jury worth its salt isn't going to award damages for death sustained during criminal behavior.
