Amsoil rep...can you explain?

Hey Guys!!!

First off, I definately don't intend to cause any bad sentiment between anyone here... this is Christmas, and that should be foremost upon our minds and hearts.

Maybe I can simplify things down to this:
I'm trying to place an online order with Amsoil. Amsoil does not have a warehouse or storefront in the Knoxville vicinity where I can pick up my products (that I'm aware of). I place my order online to have it shipped in from out of state. On the check out page, it confirms there are no warehouses in Tennessee. Yet, I am being charged sales tax as if this were an in-state purchase.

Whether this is right or wrong is beside the point. The point is, this is not consistant with any other transaction I have EVER had, and that is why it stands out so much.

Wayne, or other Amsoil rep, can you answer these questions straight forward and to the point?

1. Is there a retail outlet within 50 miles of Knoxville at which I can buy the Amsoil products and avoid shipping. These products (this order) include AME1G-CA, SSO1G-EA, SVTQT-EA, GLSCS-EA, ABCQT-CA, ATF1G-EA, MTGQT-EA, ATPQT-EA, etc.

2. Is there a place out of state that I can order these products without paying sales tax?

3. Does the organizational structure of the way Amsoil distributes products cause additional taxes inconsistant with other vendors selling similar products? For example, I can order Schaeffers, Brad Penn, Red Line, Royal Purple, Mobil One, etc out of state and not pay tax.

4. If the answer to question 3 is yes, why does Amsoil choose to operate this way? What is the benefit for the customer? I'm not criticizing, but from an outside viewpoint, it makes Amsoil products both more expensive, and harder to get than other products.

5. I am an Amsoil dealer. You (Wayne) are an Amsoil dealer. Are we the same "kind" of dealer?

6. Do you buy your Amsoil products at a lower cost than I can? (Again, I'm not complaining if you can. In fact, I think it's only fair that you can buy at a significant discount over my pricing if you offer a large retail store for profit)

No one wants to fight for what is right, corporations being sued and settling out of court = a shakedown by the mob (trial lawyers) , no one wants to take it to a trial to set precedence very sad and the insurance companies keep paying out . Taxes , Amsoil must have some Liberal bean counters saying this is what they should do instead of standing up for their customers . I would stop buying the product and tell them why.

Yes, we are the same if you are a "Dealer", rather than a "Preferred Customer", We Dealers as well as Preferred Customers purchase the products for the same prices. That said, if one purchases large amounts, like a $3,000 dollar order, you will get a 4 % discount. If you elected to have that $3,000 order sent to your tennesee adress by "Common Carrier", you would also not pay the "Sales Tax", as Tennesee is one of the States that is exempted if sent by "common Carrier".

since you are a "Dealer", look in the back of the "U. S. wholesale Price Book", and you will see everything you are asking printed there.

Speaking of Taxes, Have you ever looked at the taxes on a Cell Phone bill? In my case there are taxes on taxes!

Yep,I look it over, Do You know What the ST-3 is for? Any Company that drops the Burden on the Seller is NOT worthy of our Business. Amsoilman I cannot see how YOU can support this arrangement. I will run this again by our Ams supplier, but if they don't accept the ST-3 ,Amsoil leave Me no choice But to Drop their Products. The 7. 5% loss is not going to be taken Up By us or our customers.
 
Companies that sell products on the internet and do not collect sales tax are cheating the customer's state as that sales tax is just one of the revenues that are used to pay for police, roads, all kind of good and necessary things.

I Agree, the Problem is Amsoil is considering the Distributor as the end User ( I don't know why our Distributor cannot fix this)He keeps telling Me its Amsoil New policy,I pointed out earlier that T&C had already Paid the Tax,But the Agent for the Dept of Rev Did not care,,, the end user must be charged the Tax,T&C is the seller... NOT the end user.



Now the Real kicker, I Also Own TWR which is a small construction Company,MN law requires that all contracting be conjectural,Our Contracts state all Sales Tax included,This was acceptable according to Him. Retail sales are required to show (Paid) Tax In MN Period.

I called Amsoil Inc. this AM, as I said I would do concerning the "Sales Taxes". I was told the TC-3 form you inqueired about, is a Form from a particular State for collecting Taxes. The person I spoke with was unsure of what State that particular form was from.

She did tell me this; Because Amsoil Inc. is "registered" to sell their products in every state, it is like they have a store in each and every state, therefore they must charge the prevailing "STATE" tax to a customer, unless that customer has an "exempt" tax license registered with Amsoil Inc. , which I do. When I sell the item, then I collect the Sales tax on whatever I sell it for, then pay the State each and every quarter of the year.

And I will continue to do so. Sorry, but the state isn't going to hurt from buying online.
