Arizona Speeding Ticket question

When we were on vacation last August, I got a speeding ticket in Gila Bend, Arizona, 40 in a 35. I have a commercial driver's license and Arizona law prevents me from taking traffic school because of my license. So my option is to fight it or pay the fine and get points on my record. Anyone have a recommendation for a "Mr Ticket" type traffic lawyer in the Gila Bend area? Gila Bend is close to Phoenix in Maricopa County. Thanks.
 
My BIL is a driver, he joined some sort of a lawyer conglomerate thing that defends you in court against things like this.
Want me to get the info?
 
I lived around the Phoenix area from '01-'04. In that time, I got 4 speeding tickets and one red light ticket. I was told that since I had a CDL I couldn't attend those classes. I signed up for them anyway and went 4 times. Got me out of all the points. Maybe they've really cracked down on it since then.

Yeah, I wish I could say the same. We came down from Sedona on the way home to San Diego and my dad had told me to go through Phoenix and then east on the 10 to 8 west. We ended up on 10 west and then south to Gila Bend to the 8. What a time to ignore my dad's advice...

Check out http://www.motorists.org/ I have used their help last time I got a ticket (books, techniques) and fought it in court and got it knocked down to "Failure to Display Lamps" ;-) Not a moving violation. Reality is the town just wanted the money.

Thank you I'll check it out. A quick look shows they have links to attorneys, hopefully I can find one. Gila Bend is 6 hours from home so it's not worth it to me to fight it in person when that same money could be spent on an expert to fight it and prevent points on the record.
 
Pay it take the points and be done with it, If a point or two is a big worry about your CDL maybe a different career choice is in order, OR BECOME BETTER AT THE ONE YOUR IN!!!

I respectfully disagree. The OP stated he had received a ticket for 40 in a 35. This is a bulls**t ticket. The last time I dealt with this (2005), the best radar guns have a +- 5MPH min error. It is not because cops are nice that they usually follow the rule "8 you're great, 9 you're mine" - it is because they are taught the inherent limitations in accuracy of their radar guns. That being said, the OP did not state whether it was radar or laser. Laser guns, too, can have an issue with the speed due to the beam moving between the bumper and windshield, even when held steady on the door of the cruiser. This is all well documented. So the cop was prob trying to make his quota (I have a buddy who is a police officer and admitted to such) and if confronted with the proper evidence and known limitations of the equipment, will prob do what the city attorney did in my case, drop it to a non moving violation, no points, just-give-me-some-money "ticket". This outcome benefits the OP since points can easily translate into $$ in insurance increases and besides - given the known inaccuracies, maybe he was doing the speed limit!

Give the man a break, BIG. :) I would fight it out of principle. You never know how the case will turn out. I once had to appear in court (back when I was much younger) for a reckless driving ticket (95 in a a 55 zone) and the ticket was dropped, but I had to pay the fine, because my lawyer successfully argued that MD (where I was caught) law did not formally allow for laser speed measuring devices (since changed, I am sure). And yes, the cop had me dead to rights - I was going 95.

SLOW DOWN AND DONT BECOME A STAT!!! once out of the toilet, Stand on it because not many trucks will run as fast as the 4 wheelers do and they are the Bear Bait.

You'll spend WAY MORE MONEY than what the ticket and frustration is worth.

The way I looked at tickets like this is < Do I deserve this? Probably not!!! Have I been a speeder or some other kind of violation and GOT AWAY WITH IT? Probably So.


SO THIS IS PAYBACK TIME WHEN YOU WERE ACTING INCORRECTLY AND DIDN'T GET CAUGHT.

No way, BIG. I always follow the Eleventh Commandment: Thou Shalt Not Get Caught.... and if you do, FIGHT IT! ;-) Most speed limits are a joke and are there for misguided ideas about Glowball warming and or revenue generation.
 
Was talking with the better half about this, I at one time thought the same way as you, FIGHT IT!!

When I was trucking as an O/Operator many years ago. I stopped and got me a "Beaver Burger" at a restaurant that had exotic game (back then)

I thought that it was funny that the restaurant had a Tee Shirt that said I ate a Beaver Burger with the back of a guys head taking a dive in-between a beautiful pair of spread-eagled legs and the girl was topless. I got back in the truck and started to drive. Passed Green River UT, I'm sure that if your a driver you know what's between Green River UT and Salina UT its a 104 miles of absolutely nothing NOW!! imagine back some 30+ years ago.

Someplace along the way my Beaver Burger did a couple of flips in my stomach, it tasted worse the second time I chewed it. I had to pull over and leave a Deposit on the side of the hwy. A Beehive State Patrolman didn't think that it was to funny leaving " Human Defecation" on the side of his Hwy.

He sited me and I drove off on my marry way. Some months later I called home and the wife asked me what I was doing leaving Human Defecation on the road? I reminded her of my Tee Shirt, her reply was that it was going to cost me $150.00 that must have been a heck of a deposit!!

I thought the same as you and I was willing to take it to God All mighty. There was no rest area for the 104 miles the only thing to cover me was MY TRUCK!! So I went to the court date ( I think that it was in Richfield UT) The Judge called my case # I went before him and pled my case of no restroom for a 104 miles and what was a guy to do?

did it matter to him? NOT ONE BIT, I had a few CHOICE words that cost me an extra $25.00 each for contempt of court. Being the Smart XXX that I was then (not now :-laf) I tossed out a hundred and said I HAVE A FEW MORE WORDS OF WISDOM. He took the $100.00 and said ONE MORE WORD AND YOU'LL BE OUR GUEST FOR AWHILE!!


Moral of the story is JUST PAY THE TICKET, what's a 5 MPH ticket going to cost vs the cost of some Yahoo Lawyer going to be? is your time, money worth all the BS if it is Trucking sure has changed.
