sounds like he may have a little legal experience and may have been setting the cop up ...

BUT even if the officer is RIGHT

IMO - he has hurt the cause of police almost everyplace when this is shown... . I know some of you will disagree - HOWEVER you're in the game of Public Relations..... and this COP gets a ZERO on that account... ... I'll bet this will cost the State of UTAH a whole lot of $$$$$ - would be interested to follow.....

Its clear to me no one ever taught that guy how to behave on a traffic stop. That is something parents should be teaching, when they teach there kids how to drive and through example when / if the parent gets pulled over.

ding ding ding. I have kept quiet on this thread but decided to chime in. I use to date a cop (good lord, what a adventure that was) anyway, she once told me how I should react on a traffic stop. I knew most of it, but thanks to those couple small simple instructions, I havent gotten a ticket since. Been pulled twice, for small stupid stuff (exhaust, bumpers) and once in my old gasser for speeding (speedo wasnt working). That guy had an attitude from the get go, and was asking to get arrested. Tased, well that maybe a little far, but he was pretty adiment about wanting to obey the officer. The Officer obviously needs a lesson or two. If he simply would have said, sir please sign this ticket, and so you know, if you dont sign it, I do have to arrest you. But I dont think it would have mattered what the cop said, they guy was going to fight him tooth and nail until he did end up getting tased or asped. The guy was a moron.



Heres some tips for ya that they dont teach you in drivers ed, when you get stopped, do the following,

1. ) Turn off the vehicle

2. ) Turn on hazards

3. ) Remove Keys and lay them on the dash in front of you (plain sight of the officer)

4. ) If its night time, turn the interior dome light on

5. ) Place your DL and Insurance card on the dash as well.

6. ) Roll down the window and place hands on the steering wheel until the officer instructs you otherwise.



DO NOT REMOVE YOUR SEAT BELT!



Some might wonder WHY should I have to do that... well, its for your own safety, and the police officers as well. Traffic stops are the most dangerous situation a cop has to deal with short of domestic calls. The cop is at a disadvantage when you are in your car, and mostly obscured from his vision. And, you obviously did something to get pulled over, so you are the one that needs to listen and obey. You dont fight an officer on a ticket, if you feel like you have been wrongly accused, that is what court is for.

If you do this for a living, you of all people here should know how stupid the public in general could be and how to deal with them in a better manner than this. And I dont things will get better any time soon. :mad:

I havent gotten a ticket in over 10 years now. I always do the 6 things Alphacowboy wrote, and I have some PBA & FOP cards. :-laf

In addition to those things, if I'm about to get pulled over where there is no shoulder, or in an area where you wouldnt want to walk near the road, if there's some place close that's off the road (a parking lot, side street etc. ) I motion that I'm pulling over there.

If you make them chase you youre getting the ticket. Ask my wife... ... :-laf
 
I heard on CNN today that after review the officer was judged to have acted appropriately because the guy was reaching into a pocket.
 
no one likes being stopped. lord only knows how many times I've been stopped (drive through alot of poor small towns after hours) ,but as was mentioned earlier curtesy and tact go along way. As more of our freedoms are lost "for our protection" we are left wondering, was this fair? It is my opinion that the officer needed to explain the rules as was asked by the driver. was that so hard? or did his macho "do as I say so or else" ego get in the way? he's only human, and wrecked the drivers vacation (or worse) because he didn't feel the need to explain to this obviously confused man exactly what he was doing wrong and what the consiquences were. many on this site travel the country ,I bet it sure would be nice if all the states and counties and towns had the SAME rules. then there's no excuse. $. 02.

If the driver had actually "asked", the cop probably would have been happy to explain the situation. The driver started out combative from the word go... .



because he didn't feel the need to explain to this obviously confused man exactly what he was doing wrong and what the consiquences were.



Driver wasn't 'confused', he was a combative cry baby who thought he could complain/whine his way out of the cite. Truly confused drivers get the benefit of the doubt, guys like that driver talk themselves into every citation they get. An officer has the discretion to use the 'tool' that will change the behavior - a verbal warning, a written warning, a citation - really depends on the driver.....

that being so, the officer could have user his discretion and said," if you dont sign this ,by state law, I will have to arrest you. "

"With great power comes great responsibility" cops are given an over abundance of power ,and CHOOSE to abuse it or not. the driver was an ***** ,but in other states a signature on a citation is an admittance of guilt, so I would have questioned that too. should the cop have the right not to answer and arrest me for " not doing what I'm told"? sorry I'm not 4yrs old and you're not my dad. Until the laws are fixed and clearly understood by all, I damn well have the right to ask!! and its a gross dereliction of justice to presume otherwise.
 
Let's keep it straight here. As a human being, a police officer has certain rights. As a police officer, the power vested in him often override his rights.

As a driver, you have the right and the duty to request to see his official identification. And you have the right to call 911 to verify that ID. You also have the right to know why the officer stopped you and what his evidence is.

The officer does not have the right or power to turn a deaf ear to your reasonable requests to know why you have been stopped and why you are being cited for a moving violation. If he did have that right or power, then there would be no difference between the US and Vichy France, or Nazi Germany, or Soviet Russia, or perhaps even Mexico or a hundred other countries where people are mere chattel, where anyone could/can be stopped, detained and arrested at any time for any reason or no reason at all, or out of pure malevolence.

Police have a duty to fulfill, and they have specific, limited powers at hand. They also have specific legal, civil and social rules and regulations that otherwise bind and limit their actions.

Based solely on this video, no life, limb or property were in imminent danger. Thus the use of potentially deadly force was excessive. The officer solely cause the escalation through his continual refusal to answer the driver's lawful questions and by his failure to keep his own temper under control.
