HELP ...... Attorney advice ........ MO

Dallas Cowboys

About a month after the first incident,I went to the police station and asked for the record of that incident. Laser was mentioned in the incident, but discharge of firearm at me or in my direction was not. Chalk one up to great police work. At about that time,I got back on the job to finish up some details, and the father of the year opened the gates to let two large dogs snarl and bluff charge at my location [the dogs did stay in their own yard] Not wanting to overplay my hand,I mounted a 12 gauge within arm's reach of my position on the roof. I did not want to be holding or brandishing a weapon. The dad was busy rattling the trash cans and keeping the dogs stirred up when he looked at me to see if his agressive behaviour was having an effect on me. When he saw the Savage shotgun on the roof mount, I thouight he was gonna wet himself. No cops were called, and the guy grabbed his dogs, and told his kids in the yard to get inside. Haven't seen hide nor hair of him since.

Had the cops shown up to a "man with a gun" call. I would have calmly complied with any order they gave, but at the same time informed them that I had no intention of being put "up a tree" by those hounds from hell. I certainly would have insisted that I feel that after the lack of enforcement of the prior incident that I would be provide for my own security within the laws of this state [open carry is permitted] and that it did not suprise me at all that the matter seemed to be escalating because the police took no action when I was shot at on the prior occasion. Bullies just get worse when no one punishes bad behaviour

I did try to respect those of you who advised me not to carry openly as a response to the first incident, so I kept the firearm legally stored in the truck; when the second incident of the dogs occurred,I was sure glad to be able to respond to the threat without speaking a word.

On Edit: for for those of you who did not read the first thread--the firearm in the first thread was a pellet gun,but with modern pellet rifles capable of 1000 FPS velocity and with laser sighting as part of the retail package--that is why I consider them firearms.

I never cought the part about his dogs, only the little runts stunts. I don't blame you for carrying a weapon if there are dogs like that in the neighborhood. Heck in Alaska they carry . 45's for protection while out running, granted they are worried about the bears:-laf

The dog incident happened weeks later. I feel the guy was rubbing it in that the cops did not do anything about his little crumb crunchers or his responsibility in controlling their actions. This was really the perfect scenario for open carry. First, you need to be in OODA mode because of the speed and unpredictability of the animals. Also, any resonable police officer would have to assume that the firearm was not present to threaten any person, but to stop the threat of an attacking dog. Lucky for his dogs,I only made it thru the first three letters of OODA.

As far as anyone needing a 'whuppin,I believe he got one. One moment ,he was all butched up with his dogs, and the next they were running for cover.
