OK... so under this policy update it sounds like I can legally buy off-road diesel and legally use it until the policy is changed back to "normal". So if I go out today and pump in a tankfull of dyed fuel I will have traces of off-road dye in my system. After the policy is changed back... if I get checked won't the dye show up? Even though I am back to running on-road diesel? I assume then I would get tagged with the fines even though I technically broke no laws. How are they going to allow for those situations? Comments?



The Emergency Notice Instructions tell you to retail your receipt when you purchase off road red dye diesel. So you show proof that you paid the road tax.



President Bush and the IRS have indeed lifted the restrictions on burning off road red dye diesel as well. Below is a cut and paste of the Federal annoncement:

IR-2005-89, Sept. 2, 2005



WASHINGTON — The Internal Revenue Service, in response to shortages of clear diesel fuel caused by Hurricane Katrina, will not impose a tax penalty when dyed diesel fuel is sold for use or used on the highway.

This relief applies beginning August 25, 2005, in Florida, August 30, 2005, in Alabama, Louisiana, and Mississippi, and August 31, 2005, in the rest of the United States, and will remain in effect through September 15, 2005.

This penalty relief is available to any person that sells or uses dyed fuel for highway use. In the case of the operator of the vehicle in which the dyed fuel is used, the relief is available only if the operator or the person selling the fuel pays the tax of 24. 4 cents per gallon. The IRS will not impose penalties for failure to make semimonthly deposits of this tax. IRS Publication 510, Excise Taxes for 2005, has information on the proper method for reporting and paying the tax.

Ordinarily, dyed diesel fuel is not taxed, because it is sold for uses exempt from excise tax, such as to farmers for farming purposes and to local governments for buses.

Finally, the Internal Revenue Service will not impose the recently enacted tax penalty on a failure to meet the requirements of EPA highway diesel fuel sulfur content regulations if EPA has waived those requirements.

If you read all of the statement, you need proof that you PAID the tax. So I ask, why bother with the red stuff. Same price with red or clear. No savings unless you plan to get off road fuel in the future and not pay the tax, yet claim you did. That isn't honest and with that in mind, you should get your tank dipped and handed the hefty fine :rolleyes: I still don't see why this thread is such an issue. There isn't a savings, just permission to contaminate your fuel system with the red dye. It just ins't worth it. I myself, don't want the local guys dipping my tank, finding red, then give them a reason to keep checking me for the next year! I already tick them off with my Oregon issued DMV SEATBELT EXEMPTION that I have due to a shoulder problem. They really get ticked off when they pull me over thing that they are giving a seatbelt ticket and I fork over my card. :-laf . I would wear it under my arm but that is a ticket also, not to mention it will mess you up even more if you get smacked on the road. I just figure that the air bag will most likely break my neck if the crash is that bad anyway. (Please don't let this start a arguement for the pro's and con's of seatbelt use) :-{} My choice, my body, my life. ;) Kinda like the helmet law for bikes. If you want to wear one, great, but if you don't, don't shove a $100 ticket at me. I lived through the years back in the 50's of riding in the back of a pickup, standing up in the back seat and living to this day without death. If your time is up, it's up. . Period
 
#2 is #2 red or clear or green, your truck will love all the flavors, its about getting caught and being honest, it is none of anybodies buisiness, if you want to take the chance, than that is your deal, not ours, i know people that run red fuel for many miles and save a lot of money, but i dont reccomend it, but it wont hurt a thing on your cummins

You are correct, as I have also stated before, on or off road diesel is the same at most stations. Same pump and all. At Pacific Pride, you have 2 cards. One for off road and one for On road. Yo just don't put that nozzle in your tank if you used the off road tank as I would suspect they have cameras and they do get an audit from time to time. It is also a honesty thing. You can cheat and use the cheaper fuel and risk getting caught, but... Im not going to hell over cheating the oil companies, even though they are taking all of us to the cleaners! I think this would also go under the word Integrity. :)
