This was posted in the political forum already and yes the cop should have told him the reason for stopping him and never did through the whole ordeal.

Boy, I'd like to know how this one turned out. Yeah, the guy turned his back on the cop, but to get tased for speeding? All the guy wanted to know was how fast. I wonder how this tape got out to the public.
 
I've asked to see the radar a few time's when my speed was in question! I've never had a cop say no when asked. If they refuse to tell you or let you see for yourself, it makes you wonder if they actually caught you with radar or just the naked eye. I think that cop is a prick! The kid was asking politely throughout the whole ordeal. I have many friend's that are cop's, and I can't wait to get their input on this!
 
Saw it on the news last night on one of those msnbc or something like that! I am pretty sure if you ask to see the radar they have to show you. Also ask to see the past few tickets he has written as around here they like to keep the past speed on the radar and say you going that speed.

I know every state has their own procedures/protocols... but if you get out of the car here in NJ, the cops FLIP OUT!



IMO things escelated when they shouldnt have. The cop was a bit pre mature on the tazer.

It's easy to monday morning QB these things, that's just my . 02
 
I've been told by some friends that are cops that tazing requires the same prudence as an actual shooting. They comsider it another option instead of deadly force. I don't see how deadly force was even remotely warrented in this situation. I hope this cop gets fired for this.
 
My neighbor and hunting buddy is a deputy sheriff. We were talking about this on the way out to the duck ponds the other day. Apparently, the driver is taking the cop (and probably the department) to court. He got the video via the Freedom of Information Act and posted it. So the story goes. As far as my buddy is concerned, this dumbarse was way out of line. Definately a "how not to" video.
 
I asked a neighbor who is with the sherriff's department. We live in NJ.



He is required to inform the person that they are under arrest, what they are being arrested for and to read them their rights (Marandaize).



The failure of the officer to do these things will most likely void the arrest.



Also the opening the drivers door at the end and looking inside is an illegal search.



My neighbor said that he heard that the officer was on unpaid suspnesion. He further stated that the use of the taser was not justified, in his opinion.



In NJ we are not required to sign a citation. In the states where the signature is a promise to appear then refusal to sign would necessitate an arrest.

That driver was a complete moron. . He deserved to be tazered. He was told he was speeding. the Officer asked him how fast he thought he was going , the driver answered 68. The driver would not cooperate with the Officer. He kept telling the officer "no", then the driver told the Officer they had to go drive back and look for the speed signs???? What? argrue with the Judge in court. Not with the Officer. If you do not follow instructions you are in violation. He's lucky that dept had tazers. We don't and its hands first, then pepper spray, then asp baton, then my firearm. I'll tell you pepper spray is way worse then a tazer. With a tazer the pain stops as soon as the Officer stops applying it. Pepper spray is bad news, you are in lots of pain and discomfort for at least 1/2 hr . and thats a perfect situation.

I think most people would change their opinion if there swapped shoes and had to stand on the side of the road, with traffice flying by you less then 2 feet away, risk being shot and or killed on every traffic stop etc. There is a reason for rules and policies and most are there to increase the Safety of the Officers. This increases the odds that they can go home at the end of their tour safely to their kids and family.
 
With all due respect to the good cops out there, and thanks for the dangerous job they do, this officer could have de-escalated the situation simply by telling the driver how fast he was going. That is a legitimate question. Should the driver have walked back towards his car? No. But they wouldn't have even been away from the car if the officer had told him how fast he was going.



For 16 years I was a Park Ranger. Now, cops may laugh at that, but having to talk to people who didn't want to hear from you is a very difficult job. We got some real whack jobs, and we had nothing more than pepper spray, and that was only for a few years. You learn to NOT escalate, how to talk to people, and when the situation is going south. I only had to call the sheriff four times, twice on the same guy, in 16 years. I only had to pull my spray once. I generally got compliance through good verbal skills. Am I great? Nope, just learned how to talk to people. I think many LE folks escalate a situation, either on purpose or not. That puts them in a more dangerous situation that could have been avoided.

It's a rare day that I side with a cop, but I'll do so this time... not necessarily with the tazering, but with the arrest. My experiences with law enforcement have generally been negative. I ALWAYS run into the guy with the attitude problem, or the crooked cop, or the guy with a sense of entitlement. But those are not stories that you post on the internet.

This cop was calm, and addressed the kid in a formal manner. His instructions were clear. If a cop tells you what to do (even a dirty one) you'd better be prepared to do one of two things: Obey or defend yourself against an armed person (and the problem with defending yourself is that the legal system will not treat you fairly, regardless of the circumstances).

That kid should have obeyed the cop's commands and moved quietly to the rear of the vehicle. He should not have attemted to return to his car, where he might have tried to grab a gun, or begin a high speed pursuit... or any number of other things.

The cop was stupid for tazering him, when physical restraint would have been easy. It's not like he was busting a ****** off 300lb guy. That kid was barely bigger than his girlfriend, and tazering was not required. It makes me wonder what the real reason was for tazering him. Was he scared of the kid? just wanted to try his tazer, and jumped at the opportunity? has a problem with agression? had a history with this kid? There has to be a reason.

I dont want anyone to "not go home after their shift", but I still feel he's in the wrong. Yea, the driver was an ***, but you cant tazer someone for being an ***. Least I dont think so... ... . :D

listen to the vid and you'll hear the driver ask what he did wrong and for the cop to read him his rights a few times ...



sounds like he may have a little legal experience and may have been setting the cop up ...



the driver was being a jerk but i still think the cop tazed him too soon ...



he had it comming but i think the cop will end up in trouble ...
 
Also, I noticed after the cop handcuffed the kid, he left him laying in the road, or at least on the white line. Good thing someone didn't come too close and clip him, possibly killing him because the cop couldn't stand him up and move him out of the way! Not very smart or professional!

Generally speeding will not result in the driver being taken into custody - a ticket is an arrest and your signature is your 'bail' in most states. If you refuse to post bail you go to jail to see the judge. Some states do not require a driver to sign the citation.



Miranda applies when a person is in custody AND being interrogated regarding criminal activity. I've never Mirandized a drunk driver after the cuffs have gone on - I've got everything I need before cuffs were put on.



I do not have to tell you "you are under arrest" BEFORE I put you in handcuffs. Generally, if someone is going to fight/resist it starts when you tell them they are under arrest SO get control of the suspect first and then tell them why.



The taser was the appropriate tool for the job - going hands on with the driver has a higher risk of injury to BOTH the driver and the officer. And in this particular case if the driver and officer were wrestling on the ground the passenger could have easily joined in without the officer realizing she was out of the car until it was too late.



Cops do not have to show you the radar - it may be department policy but it's not the law as far as I know.



There's a lot of street corner legal advice on this thread that is just plain wrong.
