Gary, that comes down to the checks and balances provided by the three branch structure of our government (executive, legislative and judicial). The judicial branch can rule actions taken by either of the other two as unconstitutional... .
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
Article VI, second paragraph states:
Treaties can take precedence over the Constitution. A former Representative from Idaho, Congressman Helen Chenoweth, introduced an amendment that (originally written by Senator John Bricker from Ohio) that would have made the Constitution supreme, but the amendment didn’t pass.
It’s (past) time to write our legislators to reintroduce this proposed amendment.

The downside, of course, is that someone would have to be arrested and charged in order for the issue to come before a court.
