FY 2017 civil penalties include a $1.45 billion Clean Air Act penalty in the Volkswagen case. EPA is continuing to address mobile source Clean Air Act violations. In May 2017, EPA filed a complaint against FCA US LLC, Fiat Chrysler Automobiles N.V., V.M. Motori S.p.A., and V.M. North America, Inc.
alleging violations similar to those in the Volkswagen case, affecting nearly 104,000 light duty diesel vehicles.
EPA is increasing the deterrent effect of EPA’s enforcement program through criminal enforcement actions to address the most egregious cases. sale of approximately 103,828 diesel-fueled new motor vehicles, under the Ram
1500 and Jeep Grand Cherokee model names, (“Subject Vehicles”) that do not
comply with the Act. The applications for Certificates of Conformity (“COC”) for
the Subject Vehicles did not disclose at least eight software-based features that
affect the Subject Vehicles’ emission control system. Consequently, each Subject
Vehicle differs from the specifications provided in the COC applications and none
of the Subject Vehicles is certified by the COC that purportedly covered it. In
addition, one or more of these undisclosed software features, alone or in
combination with one or more of the others, bypass, defeat and/or render inoperative
the Subject Vehicles’ emission control system, causing the vehicles to emit
substantially higher levels of NOx during certain normal real world driving
conditions than during federal emission tests.
If found guilty Criminal Charges would follow. Unless the civil case is Settle.
