There should be no deductible or rate increase if it was the other drivers fault
When my sons truck was totaled last year,he received his check with-in a week of the
Notification of the total status it took a little over one week to get to that point

We have always had Farmers they have done us right (the wife totaled 3 of my muscle cars) and they paid for all but 1 the collectors price then. We have Farmers for everything insured so they give a pretty good deal we think. The Son had the little lizard guy Geico had a problem that wasn't his fault and they jacked him around bad. I think allot has to do with the agent of any of them.
 
Wow, I am suprised to hear that about Geico. My wife was not at fault in her wrek, I was at fault in my wrek. Geico offered to handle my wife's wrek so I could get started on the repairs imediately. I should have took that offer. I was not realy bad to deal with the other persons insurance, but Geico would have been much faster. Geico handled my wrek very well, and I can't say there was a premium increase from it. State Farm overcharged me on a car, I complained every time I paid. The last time it was due, they said "Oh, we have you in the wrong bracket". I was told no when I asked about a refund, and changed companies.
 
My brother had an accident that wasn't is fault the other driver had same insurance co. and agent. The agent tried to split the insurance claim between both of them 40/60. My brother said no way, brought the police report down to the agent and got full price for his van.
 
Why not just let the make it a Total, pay you off, then make a deal with the Insurance Company to buy the salvage, then do with it as you want.
 
Still waiting now i have my lawyer on it well see how fast **** happens now lol got estimate from body shop 9000+ frame was bent alittle but i told them i wanted to buy it back so i hope itll be ok
 
Now they want to tow my truck back in to inspect it them selves dont believe my body shop on holes an hour can do i huessw much damage a large suv at 40 mi

You are taking it a lot better than I would be at this point.



Call the insurance commision for your state. Seriously.

From the outside looking in, I'm gonna have to say you're being wayyyyy to nice. I'd have to call my agent, and if they didn't get something done Monday by lunch, I'd have my lawyer filing on them by Monday afternoon. Apparently, they must think they can jerk you around. I don't know all the details to your situation, but I do know insurance is a service provided by your agent's company. Unfortunately, the states have made that mandatory, and you have to have insurance, but you don't have to be put on hold and jerked by a chain to go where they want you..... The insurance Commission for Cali might be a good place to start, but my lawyer would be next in line, and breathing down their neck..... with whispered warnings of civil court for missed work, stress, and punitive damages..... Not that I WANT to sue anyone, but they have a signed contract to take care of your vehicle. They shouldn't have to be forced to do what they voluntarily agreed to get paid for.



And FWIW, I have insurance with State Farm, and they would have already had it fixed or almost fixed..... I got hit in the ice by a fullsize F-250 van that slid off a bridge and hit me head on... ... I was in 4x4 in the ditch, completely stopped, but couldn't back up due to cars behind me who pulled over when they saw him coming... ... DPS(State Trooper) said in his report I went above and beyond to avoid the accident, and it was 0% my fault... ... It bent the front of the frame in front of the rad supports and bent my custom winch bumper pretty bad to the side... ... That was on a Thursday, I had it back, straightened, buffed, and painted on Tuesday a week and half later... ... . :cool: I don't understand what their problem is... .
