Carter AVS question.

All you California driver's beware this EX post Facto law!

This information was kindly sent in by an alert reader.

The reason I'm writing you this e-mail is to make you aware, if you are not already, about the new attempt to take older cars off our nation's roadways. Unfortunately, this time it is actually happening, unless we as a collective force do something to stop it. The new legislation, which is at hand, allows cars to be pulled over and smog-checked at random on any public road or land regardless of the age of the vehicle, smog exempt status etc. Any car, any age, any status, whether it is smog exempt or is in fact legally certified at the time of registration... if it does not pass the roadside sniff, it is in line to be deemed a gross polluter, and we know what this means... THE CRUSHER! So you can see how your business, your patrons, your livelihood, and your hobby could be destroyed by such a law.

The failure of SB285 gives legislators the tool they need to take our classics away... legally, and we would have no recourse. Even though SB42 passed in January 1998, and exempted vehicles 25 years old and older from bi-annual smog checks, they too would be subject to roadside sniff tests. If they failed, we would lose them.

Please act now or this freedom will be lost along with so many others we have so willingly let them take from us by sheer inaction. For more info please e-mail me your fax number (hgraphics@oro.net) so that I can send you a petition form and explanation sheet, or write to Gary Ewing 8080 Townsend Dr. , Riverside, CA 92509.

I don't think they can take your car away from you... they might just not let you register it any more. You bought the car, and the right to drive it the only thing they can take away is your right to operate it on the public roads.

NO REG.

Mr. Drag Diesel,do you just want to look at your unregistered

vehicle? sitting in the garage? My Reason for this first post was

the police could pull you over,at will, maybe he did not like your

rig raised up or you have a bumper sticker He did not like ect. And

this is a law passed after an occurrence which, if applied to the fact's of this occurrence would alter the legal situation. Ex

post facto law's were used by the Nazi's in w/w 2. all I wanted was to show was how we are giving away more of our freedom's'

at a faster rate ever before! :) GWD

I do believe they can and would pass legislation to take your car, they already do in drug cases and drunk driving cases. Don't say that is different, they make the laws, then some LEO's and judges take it further then was "Intended" . I don't believe they should ever have the right. The gov should not be allow to profit from laws they write. Money from traffic fines should go to charity, preventing writing tickets and such to support there dept.

I own 4 vehicles, 1 registered, 2 on non-op due to smog laws, 1 to big to drive anywhere.

California isn't really ACTIVE in catching you on the spot... . they just get you in the end... that's how their metality has been ever since I have lived here (23 years). That's why I have more vehicles on the "curb" than on the road.

We use to have those side of the road smog check and they were hot and heavy in the mid 90's. I would drive by those things in my 77chevy WOT at like 100+mph gettin' on the freeway and then I would get a letter in the mail, and then I would just send in my smog certificate... . end of story until I did it again.

In other words, California trys to be tuff and in your face, and then they pass a law that will get you in the long run. Either way your doomed, it's just a matter of time.

Here's another little tid bit:If any of you guys have any old cars in your back yard that are off the DMV computer you would be wise to get at the least a"Title only"As there is talk of having to post a bond to do it in the future, until they make sure their is no disputes on the title. Case in point:My brothers 29 model A, he had the pink, but it was off the computer and when we ran it it was regestered to another person already. This info comes from a friend that manages a DMV office.

The DMV

MR. Catoiler,

Thank you for the info,Do you show the "pink" slip and they put you in the computer as "Title only" on an older car? I better dig around and look and try and find my old pink,I thought I could just

just go down to DMV and they would issue a new one(maybe)

this DMV stuff just get's worse all the time! GWD:confused:
