George,

You are coping and selling Copyrighted material belong to Cummins, Inc.

This CD package sells for an annual subscription of $875. 00. I have

noticed that you have received request for 13 complete sets. That

comes to

a total of $11,375. 00.

Do I sent the bill to:

I will be watching the TDR and I'm sure that you will be posting notice

that you can not and will not copy the CD's.

sorry guys

James,

I think you could have done this a little bit more proffesional manor, especially representing the Cummins name, and maybe contacted Goerge off line. There is nothing gained by doing it in this fashion other than maybe people losing respect in you for the manor in which you handled this situation.

George, I want to thank you for trying to help your fellow TDR members. I understand the situation you are in, and I was one of the several members that replied to your early post. I don't want to see you or any other member of the TDR get into any trouble so please don't think that we won't understand.

James, if you are reading this. George is allowed by law, to back-up his copy of the disk.

BigBadDodge,

James did not post directly on this site. This is a copy of the e-mail or written letter to George from him.

Let this be a warning to you guys that think the Cummins and DC guys are not watching this site.

who should i send the bill to ??????????

Mr. Ford: as i bow before you oh exhaulted one!!!!!!!!!!!!!!! possibly a little more tact is in order????????????????????? oh dear, a member of the copyright police is among us!!!!!!!!!!

I hope this is a joke!! I really don't care for James last name. :p He prolly don't like mine neither:D He has BOMBed his trk. tho, I wonder if Cummins covers his warranty yet? :)

I may be new to this board but i've got to say i was very dissapointed to see someone try to copy and sell copyrited material. I'm also dissapointed the moderator did not stop this, i have no ties with cummins but would be POed if someone blatenly tried to sell something i made my living with for peanuts behind my back. Sorry guys but you have no grounds to attack James. JMHO.

I was not attacking James for what he did, but for the mannor in whch it was done. and if he is not the one who posted the letter on this board, then I appoligize to him. I just don't think that the letter should have been posted here on the boards no matter who did it.

BowRon,

I think most guys did not like the tone of James. I dont like the idea of people stealing copywritten material either. Dont think for one minute I want any more censorship from moderators though.

George,

you aint in any trouble with anyone. Just dont sell the CD's and you CAN make your own back-ups of your data.

James,

thanks for the heads up:D

parts CD

george... ... thanx again for the thought... ... ... it's too bad we can't have a copy to help us when we need parts. it seems to me that if we had a way to determine the parts number for a part when we need one, WE AND CUMMINS WOULD BOTH BE WINNERS. i'd think Cummins would sell more parts if we could know what the part is that we need, and save the parts man some time..... :--) seems to me we should all get one of these CDs with our new trucks... ... .

If this is just a parts CD, what's the big deal? I'm suprised nobody has done this: Sled Parts Online Just pick the year and model. Then pick which area of the sled you need parts from. You get the parts fische up with part numbers and prices.

Re: Cummins ISB parts CD

Dear Mr. Ford,

In view of the demand for correct part numbers, and in view of the loyalty of the TDR membership toward your Company's product, perhaps it would be a good idea to provide us with some sort of members only, secure version of the CD through this website. I'm not very computer literate, and so I don't know how it could be done, but since our main desire here will ultimately HELP Cummins SELL MORE parts, we think it would be a GOOD idea.

We understand you are auditing these posts.

Please respond by posting an answer on this board.

Thank you.

Sincerely, Thousands of TDR members

My Case/ IH dealer supplies a disc for my tractors for free and gives a 5% discount when I order parts using a part number rather than having them look it up. John Deere has a website with exploded view parts illustrations/lists for all their equipment. Mr Ford are you listening? I could see a problem if George was selling for profit but this isn't the case. Leave it be, it only makes things easier for you.

Not being familiar with the CD in question, I did not comment on this. However, I should make it clear that TDR cannot allow this forum to be used to illegally sell or even give away information that's copyrighted.

If this Mr Ford works for Cummins and really is reading this, I'd like him to email me so I can establish his credentials, as well.

There is an interesting legal question here, as well. A lot of aftermarket parts manufacturers for Cummins (and other companies, too) do not use the "official" part numbers, but will use some variant of them, apparently due to legal constraints in using even just the part numbers.

ON the other hand, the subscription to Cummins for the CD's includes more than just being tossed a cd or set of cd's in the mail. There are updates, support via phone, and other services of value that come with them, and certainly the charge is not just for the $. 50 discs themselves, but for the whole package of services, as well as the right to view and order from the documents.

Some manufacturers have a collection policy, where the old media is collected by the reps, to enforce the confidentiality policy. Some are just told to destroy them, and others apparently have no enforceable policy, assuming that the newness and completeness of the data coming from the value added services is sufficient incentive for people to stay in it.

However these discs made it to Ebay, they are probably not brand new or all that recent, AND the prospective users are not intending to use this data to harm or compete with Cummins Engine Company. I would certainly hope that anyone from Cummins has the foresight to realize this is probably a benefit rather than a harm to them, and choose to enforce any copyrights with good judgement and an eye toward public relations, rather than viewing this as a major loss to a competing manufacturer of parts or service data.

Parts

I agree this is a loss for cummins. We are not trying to steal any thing from them. We are just trying to make it easier for ourseves to buy more parts for our trucks, and make the Cummins parts departments job easier.

Case in point. I called Cummins South West to see if they had a map sensor in stock. The parts man didn't even know what a map or pressure sensor was. After expaining what it was and where it was, he brought up a picture up on his computer and said to me, Boy there are a lot of sensors in that area.

I had to remove my old one and give him the part number.

I thought I made a mistake and was talking to a Dodge parts man.

parts manual

When I was in the outboard repair business, as an independent shop, the manufacture initially did not want the franchised dealer to sell us the parts and price books. They thought it would hurt their business. We convinced them to let us try it for a year. Well, surprise surprise! Not only did their parts business improve but the local dealers were most happy with the fact that we could supply them with exact numbers filled out on the proper order sheets. All they had to do was send it in for processing.

Another advantage was the ability to trace a part back thru the years to look for retrofits. It also allowed us to spend our time looking for parts that could fit across different models- something for which parts dept. personel usually do not have the time.

It was a win/win for everyone. I don't see why Cummins or Chrysler could not offer us the microfiche or cd discs or whatever method they deem appropriate. There are no trade secrets involved and the business goes directly to them- so what is the problem??
