Never had to fix a vehicle with insurance money before.

I'm satisfied that the bodywork/mechanical will get done and paid for. How do I make sure to get consequential damages like loss of use, and diminished value of truck?

I'm also demanding two rear tires to keep from overloading the LSD. The tow truck damaged the trailer electric connection too.

Wade,

I don't know about your sate, but here in WA the other guys insurance will say that here is a Geo Metro for a week while your truck is in the shop. When this happened to my friend (I have been lucky never to have wrecked the truck), he complained to his agent who said BS, you can have a similar type vehicle. So he went down to Ryder and rented a bright yellow pick-up, for the week. Now if this wreck is on your own insurance they probably have a dollar limit per day that they will pay and thus you are screwed by your own company that you have paid tons of money too over the years.

For diminished value of the truck I think you are out of luck. They will say something like we made you whole by fixing the truck so that you can't see that there was ever any damage.

Complain and you should be able to get two new rear tires, it is a safety issue?? Correct??

For the trailer connection I don't know, it is part of the wreck so insurance should cover it.

good luck,

steve

My company also covers the other party who was at 100% at fault.

They will pay for loss of use (not rent a car dues) I'm not renting one.

Even if you don't practice law--you make a lot of friends who do when you go to law school. ;)

I'm not asking for more than I'm entitled to in TN. They better not diddle around--I'll go to the chiropractor!

Wade, remember that your insurance company (and thiers) are not your friend. Keep your law friends close by. My hot rod got hit last year thru absolutly no falult of mine. April will be a year. I have now two lawyers, one suing the party that hit me and the other to sue my insurance company for lack of good faith. This was on an insurance policy that had a set agreeded to value, both insurance companies agree on the cost of fixing, etc. Make sure you know what your insurance master policy says along with exceptions. Hopefully yours is straight forward. Good luck.
