The town is breaking my shoes over my truck, a resident may not keep a vehicle registered over 10,000 lbs in town. I have a dually so its 12,000. How can I lower my gvw??? I would not object to putting 19. 5 singles all around and a flat bed. Then go to the DMV and say I do not have 4 wheels in the back lower mgvw??? I need you help please. . AT this time Dr. s have me 100% disabled so I do not have the coin to trade this in for a new one.
 
Is 12,000 lbs. your actual weight or GVW?

I would think if it wasn't a commercial truck it would be allowed.



You could try to have your GVW declared to a lower number. Like 9,999 lbs.
 
They'll probably just look at the sticker to determine GVW. VA had a table of they just looked trucks up on so there was nothing you could do. Of course it worked in my favor there since I didn't need a smog check with my GVW. I don't think anything you change on your truck will change the DMVs mind.

Can you register it in another town? Something doesn't seem right. It's not a commercial truck, it's a light duty vehicle.

12000 is your GVWR, not your GVW. Your GVW is 8000 lb. Am I missing something?

I don't know about NY but in Calif, the registration is based on unladen weight and not gross weight. Go back to the scales and get a certified vehicle weight certificate. Have the scale master put down your VIN number on the cert. Take it to your DMV and have it changed. Ask to speak with a DMV supervisor and see what the registration is supposed to say... Gross weight or Unladen weight. Here in Calif they charge you more $$ on your registration the more the truck weighs. I had a 2wd, '01. 5 that weighed in at 6125lbs. A friend of mine that has a feed mill told me that if I could get my truck to weigh UNDER 6,000lbs that I would save $50. 00 each year on weight fees. Well..... You know what I did ;)

In Florida on trucks (don't know about cars) they charge you for GVWR. I have had the Mule declared at 9,999 lbs since I've owned it(factory GVWR 8,800lbs). The Frieghtliner is decalred at its actual GVWR of 23,000 lbs.

In NY all pickups over 5,500 lbs empty have to have commercial plates. It used to be all of them. Sucks because certain NY roads, like the Palisades Parkway, do not allow commercial vehicles and they kick pickups off (or they did up to 1990 anyway). Hopefully they don't do that anymore.



First things first, MBE needs to check the local ordinance to see if it is unladen weight or GVWR.
 
I'd probably check with local police, town council, or whoever and get further clarification. Maybe go before town council and try to get a grandfather variance.



Then again, maybe it would just be better to ignore the ordinance and go before a judge when/if you get cited and plead your case.
 
Sorry to hear about the trouble. You really need to go and get the ordinance or whatever it is and read it thoroughly. I've found that what you are told is often an interpretation that can easily be wrong. Also I've found that there is often a variety of exemptions that might apply. I once got ticketed for parking my travel trailer in front of my house the day before we left on a camping trip. When I read the ordinance there was an exemption for loading and unloading, which I was doing in preparation for the trip. I used that exemption to get the ticket tossed. Read and understand what the rules really say, just don't go by what you're told by some city official that probably doesn't like trucks anyways.
 
Have they actually seen your truck? Or are they just going by something they got fromt he dmv. I wouldn't think they are actually going after pickups. The intent is probably to get those unslight panel trucks etc, out of neighborhoods, not your truck, you just unfortunately got caught up in a poorly written ordinance. I'd take the truck and copy of the weight certificate and go talk to someone.



If that doesn't work go to the paper(s) and tell your story. A disabled person unable to keep his pickup at home? That ought to go over real well.
